Finding of Fact: The Special Magistrate made a finding in CE -18-000370, 1036 Osceola Trl, it was found that the <br />property was in violation of maintenance, 1-4.1 which adopts 101.6 SHC 1994 ED based on testimony and <br />evidence. It was found that the property was in violation of the above code, it was ordered that the property come <br />into compliance by 1:00 pm, October 25, 2018, if there is no compliance a fine of $100.00 per day would be <br />imposed for each day of non-compliance. Another hearing will be held on November 8, 2018, 6:30pm to <br />determine if there has been compliance. <br />1-1AW030 <br />CE -18-001356 1100 436 SR <br />• Temporary structures, ULDR Section 2-7.9.a.7.a.2 <br />• No building permit, City Code Section 1-4.3 <br />• Refuse container screening, ULDR Section 3-10.2.3.a.iv <br />Mark Campbell, Code Compliance Supervisor advised that the Zoning district is RMF -20. Notification date was <br />June 29, 2018, correction date requested was July 31, 2018 found non-compliant. Hearing notice date was <br />September 12, 2018, correction date requested October 10, 2018 found non-compliant. <br />The property was found to be non-compliant on October 10, 2018. The City requests a correction date of <br />December 13, 2018. If no compliance by December 13, 2018, then a fine of $200.00 per day should then be <br />imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of December 13, <br />2018 to determine compliance. <br />Tim Alcuri, Senior Code Compliance officer advised that the proeprty was inspected on June 8, 2018 for a number <br />of things that were done without permits. A wall with no permit and dumpster not enclosed. Mr. Alcuri has spoken <br />with the property manager, this is the reason the City was asking for the compliance date asked for, this will give <br />time to finish the permitting process. <br />The Special Magistrate asked if the property owner or representative for 1100 SR 436 was in the audience. It was <br />ordered that the property come into compliance by 1:00 pm, December 13, 2018, if there is no compliance by that <br />date and time a $200.00 per day fine will be imposed for each day violation(s) continue. Another hearing will be <br />held on December 13, 2018, 6:30 pm to determine if there has been compliance. <br />101 *VAWV."%13 y <br />CE -18-001462 873 E 436 SR <br />Window sign requirements, ULDR Section 3-16.c.3.b <br />Mark Campbell, Code Compliance Supervisor advised that the zoning district is CG. Notification date was <br />August 17, 2018, correction date requested was August 28, 2018 found non-compliant. Hearing notice date was <br />September 5, 2018, correction date requested was October 10, 2018 found non-compliant. <br />The property was found to be non-compliant on October 10, 2018. The City requests a correction date of October <br />25, 2018. If no compliance by October 25, 2018, then a fine of $50.00 per day should then be imposed for each <br />day of non-compliance thereafter. The City requests a subsequent hearing date of November 8, 2018 to determine <br />compliance. <br />Tim Alcuri, Senior Code Compliance officer advised that there has been no contact from this business.
