David Bowlin, attorney for Family Dollar (the lessor) stated that thirty days was being asked for. <br />Finding of Fact: The Special Magistrate made a finding in CE -18-002459, 1040 Seminola Blvd for a violation of, <br />Fence in disrepair, ULDR Section 3-10.3.b.L Based on testimony, evidence and photographs it was found that <br />the property was not in compliance. It was ordered that the property come into compliance by 1 pm November 8, <br />2018, if there is no compliance by this date and time, a fine of $50.00 per day will be imposed. Another hearing <br />will be held on November 8, 2018, 6:30pm to determine compliance. <br />REDUCTION REQUEST <br />CE -11-01041 1432 Easton Way <br />Roofs, gutters and down spouts maintenance, ULDR Section 3-10.3.a.4 <br />Mark Campbell, Code Compliance Supervisor advised that the original hearing date was July 14, 2011, <br />correction date requested was August 14, 2011. Fine amount imposed by Board was $25.00 per day, <br />compliance date after demo of structure was August 28, 2018. Total amount of lien on property was <br />$64,225.00, amount requested to reduce to by new owner $1,250.00. <br />The City recommends approval of the currents property owner request to reduce the lien amount to $1,250.00. <br />The property is in compliance by way of removal of the structure. All administrative costs have been paid. <br />Jeannine Evans, 1105 Superior Ct; Winter Springs, FL stated that she plans on putting a new structure on the <br />property, pretty it up and release it into the tax base of Casselberry. <br />The Special Magistrate asked what the issue was with this property. <br />Ms. Evans advised this was a singlewide trailer that was dilapidated and had been sitting for years. The property <br />had been cleaned up since August (2018). <br />Finding of Fact: The Special Magistrate made a finding in CE -11-01041, 1432 Easton Way on application for <br />reduction or revision of lien. After hearing testimony and evidence, it was found that the cause had originally <br />come be for hearing on July 14, 2011 when a fine was imposed. The fine began to accrue and was recorded on <br />October 11, 2011. The accrued amount was $64,225.00, based on testimony on October 11, 2018 the Magistrate <br />recommended reduction of the lien to $1,250.00. This a recommendation to the City Commission to be heard at <br />the December 10, 2018 Commission meeting, 5:00 PM. <br />NEW CASE <br />CE -18-000370 1036 Osceola Trl <br />• Maintenance, 1-4.1 which adopts 101.6 SHC 1994 ED <br />• Public nuisance/overgrowth vacant property, City Code Section 58-162 (Violation withdrawn) <br />Mark Campbell, Code Compliance Supervisor advised that the zoning district is RMH-8. Notification date was <br />February 14, 2018, correction date requested was March 14, 2018 found non-compliant. Hearing notice date was <br />August 27, 2018, correction date requested was September 12, 2018 found non-compliant <br />The property was found to be non-compliant on October 10, 2018. The City requests a correction date of October <br />25, 2018. If no compliance by October 25, 2018, then a fine of $100.00 per day should then be imposed for each <br />day of non-compliance thereafter. The City requests a subsequent hearing date of November 8, 2018 to determine <br />compliance. <br />Fred Eastwood, Code Compliance Officer stated the trailer is dilapidates, there is trash all around and described <br />photographs. <br />Thomas Evans, 1105 Superior Ct; Winter Springs, FL advised that a lot of the work has been done already, so the <br />rest of the work should be done by the 25th (of October). <br />3 1 P a g e <br />
