CASSELBERRY CITY COMMISSION <br />Minutes of October 22, 2018 — Regular Meeting <br />Page 12 of 16 <br />LAW, THE PROPERTY TO BE ANNEXED SHALL BE ASSESSED FOR PAYMENT OF <br />MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE COPIES OF <br />THE ORDINANCE WITH THE CLERK OF COURT AND THE SECRETARY OF STATE OF <br />THE STATE OF FLORIDA; AND PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />Staff Presentation: Planner II Dean Fathelbab gave an overview of Ordinance 18-1498 which annexes to <br />and includes within the corporate limits of the City of Casselberry vacant property located on Lake Howell <br />Road, Property Identification Number 28-21-30-300-0400-0000, comprised of approximately 0.43 acres <br />and more particularly described on Schedule A to this Ordinance. The current owner of the subject property <br />is EPA- Lake Howell, LLC. The subject property has a Seminole County future land use designation of <br />Commercial and a zoning designation of RP (Residential/Professional). The property proposed for <br />annexation is contiguous to the municipal boundary; is well-defined and is a compact area; is not included <br />within the boundary of any other municipality; and does not create a pocket or enclave. <br />Proper notice of the City's intent to annex was provided to Seminole County on October 5, 2018 in <br />accordance with Florida Statutes Section 171.004 relating to voluntary annexation. If approved on first <br />reading a Notice of Public Hearing advertisement will be placed in the Orlando Sentinel for two consecutive <br />weeks (November 8, 2018 and November 15, 2018) prior to the City Commission public hearing and second <br />reading on November 19, 2018. After adoption, the City Clerk will notify the Seminole County Clerk of <br />the Circuit Court, the Chief Administrative Officer of the County, and the Department of State within seven <br />(7) days of the adoption. Once the subject property is annexed into the City, it will be provided a City <br />future land use and zoning designation similar to the adjacent properties. <br />In response to questions from the City Commission, Mr. Fathelbab advised that: the applicant was anxious <br />for the property to be annexed into the City limits; it was anticipated that the site would most likely be <br />developed with an office building and parking; there was currently another annexation application pending; <br />and other opportunities for future annexations existed in the area. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 18-1498 on first reading. <br />Audience Participation: No one came forward to address Ordinance 18-1498. <br />MOTION: Commissioner Solomon moved to approve Ordinance 18-1498 on first <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />B.
