CASSELBERRY CITY COMMISSION
Minutes of July 23, 2018 — Regular Meeting
Page 12 of 19
"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY
UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL
REGULATIONS, ARTICLE V, SECTION 2-5.3, TABLE 2-5.3 LAND USE BY DISTRICT, TO
AMEND THE USES PERMITTED IN THE INDUSTRIAL ZONING DISTRICTS; AND
AMENDING ARTICLE VII, GENERAL REGULATIONS, SECTION 2-7.28, INDUSTRIAL -
MEDIUM DESIGN AND PERFORMANCE GUIDELINES, TO INCLUDE INDUSTRIAL AND TO
MODIFY LOCATIONAL CRITERIA AND DESIGN GUIDELINES; PROVIDING FOR
CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE."
Notice of Public Hearing: The Notice of Public Hearing relative to first reading of Ordinance 18-1488
was advertised in the Orlando Sentinel on Thursday, July 12, 2018.
Staff Presentation: Development Services Manager Emily Hanna gave an overview of Ordinance 18-
1488 which amends Section 2-7.28, Industrial -Medium design and performance guidelines and amending
Section 2-5.3, Table 2-5.3, Land Use by District to add specific uses with distance separation requirements
within the industrial and Industrial -Medium zoning districts. Staff is proposing the following two
modifications:
1. Modifying Section 2-5.3, Table 2-5.3 to include a "P" for permitted use under the Industrial
zoning district as it relates to the adult entertainment establishments/sexually oriented
businesses land use.
2. Modifying Section 2-7.28, Industrial -Medium design and performance guidelines:
a. Changing the name to Industrial and Industrial -Medium district distance requirements.
b. Removing outdated language as it relates to performance criteria for Industrial -
Medium zoning district.
c. Include a distance separation requirement for adult entertainment establishments and
sexually oriented businesses at a distance of 250 feet from any place of worship, park
or area zoned for residential uses. Distances are measured by drawing a straight line
from the nearest property line of the adult entertainment establishment/sexually
oriented business to the nearest property line of the property being used or zoned for a
place of worship, park or residential use.
The Planning & Zoning Commission, serving as the Local Planning Agency (LPA), unanimously
recommended approval of this item at its meeting on July 11, 2018.
City Attorney Reischmann advised that one of the findings in the ordinance referenced studies and case
law, and there was a notebook containing those studies and case law that she would make available to the
City Commission if any of them wished to review it.
In response to a question from Vice Mayor Meadows, Ms. Hanna advised that the 250 foot distance was
calculated by looking at different buffer lengths and using the guiding number from 1999 case law for the
number of sites the City was required to have per the number of residents in order to neither increase or
decrease that number. Ms. Reischmann added that the City was already confining the adult entertainment
and sexually oriented business classification to industrial zoning so the distance requirement would not
apply to everywhere in the City.
Budget Impact: There is no impact to the City Budget.
