CASSELBERRY CITY COMMISSION <br />Minutes of May 14, 2018 — Regular Meeting <br />Page 10 of 18 <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE, PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, TABLE 2-5.3, LAND USE <br />BY DISTRICT, TO REGULATE PHARMACIES AND MEDICAL MARIJUANA DISPENSARIES <br />SIMILARLY; AMENDING THE CITY CODE OF ORDINANCES, PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, SECTION 5-21.2, DEFINITION OF TERMS, TO INCLUDE <br />PERTINENT DEFINITIONS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 18-1477 <br />was advertised in the Orlando Sentinel on Thursday, May 3, 2018. <br />Staff Presentation: Chief Planner Emily Hanna gave an overview of Ordinance 18-1477. The following <br />two modifications to the City of Casselberry City Code, Part III, Unified Land Development Regulations <br />(ULDR's) Section 2-5.3, Land Use by District and Section 5-21.2, Definitions, to include language as it <br />relates to Pharmacies and Medical Marijuana Dispensaries are being proposed by staff.- <br />Section <br />taff: <br />Section 2-5.3, Table 2-5.3 Land Uses by District will be amended to include a specific land use <br />category for pharmacies. This specific land use will also include medical marijuana <br />dispensaries, since the State of Florida requires municipalities to treat medical marijuana <br />dispensaries like pharmacies. Pharmacies will be broken up into two essential categories: <br />principal and accessory. Principal pharmacies are those whose sole purpose is to sell <br />prescription drugs. An accessory pharmacy is one which is located within and in conjunction <br />with a drugstore or grocery store. <br />Section 5-21.2, Definitions, will be amended to include definitions for land uses as it relates to <br />the changes to Section 2-5.3, Table 2-5.3. These definitions include Drugstore, Grocery Store, <br />Institutional Pharmacy, Medical Marijuana Dispensary and Pharmacy. Modifications are also <br />being made to the Medical Services definition to include allowing Institutional Pharmacies. <br />Staff has made the following minor edits to Ordinance 18-1477 since first reading on March 26, 2018 <br />pertaining only to definitions of terms as they relate to pharmacies and medical marijuana dispensaries: <br />Modifying the definition of Institutional Pharmacy adding that it must be in conjunction with <br />medical services, a hospital, nursing home, clinic or other related medical facility. <br />Modifying the definition of Medical Marijuana Dispensary to change the title to "Medical <br />Marijuana Dispensing Facility", and making modifications to the definition so it aligns with <br />Section 381.986, Florida Statutes. Also adding language to the end of the definition to state <br />"A Medical Marijuana Dispensing Facility does not prepare, transfer, cultivate or process any <br />forms of marijuana." <br />Modifying the definition of Pharmacy to add language that stipulates this specific definition is <br />for the retail dispensing of medicinal drugs for the purpose of the Land Development Code, <br />and expanding on the description of Medical Marijuana Treatment Center Dispensing Facility <br />to relate to Florida Statutes and/or the Florida Administrative Code. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Chief Planner recommended adoption of Ordinance 18- <br />1477 on second reading. <br />
