Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 13, 2018 <br />Page 5 <br />She said the recommendation is based on the findings of fact and conclusions of the staff report dated June 13, <br />2018, and the three findings listed in the staff report. <br />Mr. Henson explained that the City is requesting that the property owner update the zoning designation to <br />be consistent with the future land use designation. He said that the applicant is not constructing a ten -story building <br />on the property. He said that the Planning and Zoning Commission would be reviewing the site plan at a future <br />meeting. <br />In response to the Commission's question, Ms. Hyson explained that the PMX High (Planned Mixed -Use: <br />High Rise) and PMX-Mid (Planned Mixed -Use: Medium Rise) are compatible with the MTMU Future Land Use <br />Designation. She said that the applicant chose the PMX High due to the size and dimension development criteria. <br />Ms. Emily Hanna, Development Services Manager, explained that the applicant chose the high intensity due to the <br />current impervious surface ratio (ISR) exceeds the PMX mid criteria for that zoning. She said in order for them to <br />rezone and be compatible the high intensity designation was chosen. <br />In response to the Commission's question, Ms. Hyson stated that another party owns the McDonald's site <br />and they would need to initiate the rezoning process. She said an adjacent property owner contacted her after <br />receiving the notification regarding the rezoning and is interest in rezoning their property to be compatible with the <br />future land use designation. <br />Mr. Henson asked the applicant to come forward. Mr. Todd Mathes, Benderson Development, 7978 Cooper <br />Creek Boulevard, University Park, Florida came forward. Mr. Mathes said they became aware of the zoning issue <br />when moving forward to redevelop the restaurant outparcel. He said the rezoning is being done so that the site <br />conforms with the correct category. Mr. Mathes said there are no plans to make any changes to the remainder of the <br />property. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Mr. James Murray, 2323 Sierra Lane, Casselberry, Florida came forward. Mr. Murray said his only <br />concern is possible increased cut- through traffic on Lake Howell Lane. <br />
