No one came forward. <br />Mr. Henson asked for a motion to address SP 17-04. Ms. Campbell made a motion that the Planning and <br />Zoning Commission provide a recommendation of approval to the City Commission for the Casselberry Marketplace <br />(SP 17-04), final plat based upon the final plat dated December 5, 2017, the findings of fact and conclusions of the <br />staff report dated February 14, 2018, and the two (2) conditions outlined in the staff report including Attachments A- <br />C. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. <br />Eleventh Item of Business: LPA 18-01 Medical Mariivana Moratorium Extension: An ordinance to extend a <br />temporary moratorium prohibiting the operation of Medical Marijuana Treatment Center Dispensing Facilities <br />within the City of Casselberry for a period of ninety (90) days. <br />Ms. Emily Hanna, Chief Planner, reviewed the information provided in her memorandum dated February 14, <br />2018, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Ms. Hanna said staff requests that the <br />Planning and Zoning Commission recommend approval of LPA 18-01 and hereby extend a temporary moratorium of <br />ninety days prohibiting the operation of Medical Marijuana Treatment Center Dispensing Facilities. <br />A brief discussion ensued regarding classifying pharmacies as a primary use or as an ancillary use and <br />allowing the use based on the zoning classification. Ms. Hanna stated that staff would bring the medical marijuana <br />dispensaries back to the Planning and Zoning Commission in March. <br />Ms. Hanna explained that this item has gone to the City Commission for approval on first reading due to the <br />expiration of the moratorium on February 24, 2018. She explained that according to Florida Statute the moratorium <br />would not expire as the item is considered "in process". Ms. Hanna said the second reading is scheduled for <br />February 26, 2018. <br />A brief discussion ensued regarding prohibiting medical marijuana dispensaries in the City. Ms. Hanna <br />explained that the residents in Casselberry voted in 2016, 78-80% in favor of medical marijuana. A discussion <br />ensued regarding the difference of being in favor of medical marijuana and allowing a freestanding medical marijuana <br />dispensary in the City. <br />
