Planning & Zoning Commission/ <br />Local Planning Agency <br />August 9, 2017 <br />Page 5 <br />the site plan dated July 20, 2017, the findings of fact and conclusions of the information provided in the staff report <br />dated August 9, 2017, and the six (6) waivers and the nine (9) conditions of approval outlined in the staff report. <br />In response to the Commission's question regarding the illegal clearing of the lot and possible fines on the <br />property, Ms. Hanna said she would research it. A general discussion ensued regarding the impervious surface ratio, <br />the fencing of the trail and flooding concerns in the area. <br />Mr. Phillips complimented staff in working within the constraints of the site. Ms. Hanna stated that <br />Addendum 3 was distributed to the Commission regarding the project meeting the school concurrency requirement (a <br />copy is attached and made a part of the minutes). <br />Mr. Henson asked the applicant to come forward. Mr. Tom Sullivan, 301 E. Pine Street, Orlando, Florida <br />came forward. Mr. Sullivan said he would appreciate the Planning and Zoning Commission's support. In response <br />to the Commission's question regarding the lot clearing, Mr. Sullivan said he was not aware of it. Mr. Sullivan said he <br />would look into the lot clearing. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />After a brief discussion regarding the parking requirements for the site, Mr. Henson asked for a motion to <br />address SPR 16-18. Mr. Phillips made a motion that the Planning and Zoning Commission reviewed the <br />Development of Community Impact site plan application for Legacy Place (SPR 16-18) and provided a favorable <br />recommendation to the City Commission. The recommendation is based on the site plan dated July 20, 2017, the <br />findings of fact and conclusions of the information provided in the staff report dated August 9, 2017, and subject to <br />the six (6) waivers and the nine (9) conditions of approval outlined in the staff report including Attachments A — F. <br />Mr. Bryan seconded the motion. The motion passed unanimously by voice vote. <br />Ninth Item of Business: SPR 17-06: Wawa. A request to develop a fuel -dispensing service station located at <br />1033 State Road 436. Parcel ID 21-21-30-300-003F-0000. <br />Mr. Dean Fathelbab, Planner I, reviewed the information provided in his memorandum dated August 9, 2017, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes).
