Planning & Zoning Commission/ <br />Local Planning Agency <br />August 9, 2017 <br />Page 4 <br />State Road 436, Suite 1050, based on the findings of fact and conclusions of the staff report dated August 9, 2017, <br />and the six (6) conditions of approval outlined in the staff report. <br />In response to the Commission's question, Ms. Hyson said that there was a tattoo establishment located at <br />this location in the past. <br />Mr. Henson asked the applicant to come forward. Mr. Efrain Cruz, 500 State Road 436, Casselberry, <br />Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 17-14. Mr. Phillips made a motion that the Planning and <br />Zoning Commission approve CU 17-14 to allow a non-traditional use (body art establishment) at 500 State Road 436, <br />Suite 1050, based on the findings of fact and conclusions of the staff report dated August 9, 2017, and the six (6) <br />conditions outlined in the staff report including Exhibits A - C. Mr. Bakalla seconded the motion. The motion passed <br />unanimously by voice vote. <br />In response to the Commission's question regarding limiting multiple/similar businesses in the City, Ms. <br />Hanna explained a business needs to meet zoning requirements and the City Code does not limit the number of <br />similar businesses. <br />The agenda order was modified. <br />Eighth Item of Business: SPR 16-18: Legacy Place Townhomes. A request to develop a 69 -unit townhome <br />subdivision located at the northeast intersection of Murphy Road and Seminola Boulevard. Parcel ID 26-20- <br />30-5AR-ODOO.1300. <br />Ms. Emily Hanna, Chief Planner, reviewed the information provided in her memorandum dated August 9, <br />2017, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Ms. Hanna said staff requests the Planning <br />and Zoning Commission review the Development of Community Impact site plan application for Legacy Place (SPR <br />16-18) and provide a recommendation to the City Commission.
