Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 14, 2018 <br />Page 5 <br />Planning and Zoning Commission recommend approval of LPA 18-04 and hereby amend the Unified Land <br />Development Regulations to regulate Pharmacies and Medical Marijuana Dispensaries. <br />In response to the Commission's question, Ms. Hanna said that there are currently 3 - 4 principal use <br />pharmacies in the City. She said that the Cambridge Oaks Pharmacy would be prohibited based on the proposed <br />ordinance. She said the pharmacy would be considered a non -conforming use and it would be allowed to continue <br />until the use seized for 90 days. <br />In response to the Commission's question, Ms. Hanna said that the City cannot impose additional <br />regulations for principal pharmacies. A brief discussion ensued regarding an accessory pharmacy such as Target <br />selling medical marijuana. Ms. Hanna said she did not think that would come to fruition in the near future because it <br />is cash only and those establishments would not want to dispense marijuana. She said if it is determined certain <br />institutions sell/dispense medical marijuana then staff may want to revisit regulations for accessory pharmacies. <br />A general discussion ensued regarding allowing medical marijuana dispensaries in the City, the limited <br />number of dispensing licenses available, how other cities are regulating medical marijuana dispensaries and the <br />expiration of the current moratorium. <br />In response to the Commissioner's question, Ms. Hanna explained that the City was allowed one 90 -day <br />extension on the moratorium and that moratorium expires the end of May. Ms. Hanna said that a new moratorium <br />could be done once the City has adopted regulations. <br />A brief discussion ensued regarding the one medical marijuana treatment center in Central Florida, the <br />number of dispensing licenses allowed and the distance separation from other pharmacies and schools. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. In response to <br />Mr. Casselberry's question, Mr. Henson explained that the State requires that medical marijuana facilities must be <br />treated as a pharmacy. Mr. Casselberry suggested adding regulations to prohibit the use of medical marijuana on <br />the pharmacy property. Mr. Henson explained that the City cannot regulate the consumption of medication at <br />pharmacies. Mr. Casselberry was concerned that doctors would provide medical marijuana samples to their patients. <br />
