Mr. <br />Van Meter seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 17.22: 100 Live Oaks Boulevard. A conditional use request to allow the <br />consumption of alcoholic beverages in conjunction with a restaurant operation in a CG zoning district. <br />Parcel ID #: 17-21-30-517-OA01-0000 <br />Ms. Christina Hyson, Planner I, reviewed the information provided in her memorandum dated January 10, <br />2018, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Ms. Hyson said staff recommends the <br />Planning and Zoning Commission approve CU 17-22 to allow the sale of beer and wine (2COP) for on-site <br />consumption at 100 Live Oaks Boulevard based on the staff report dated January 10, 2018 and the twelve (12) <br />conditions of approval outlined in the staff report. <br />A discussion ensued regarding the conditions of approval for SPR 01-09 (Attachment D) that required a <br />cross -access parking agreement for the original site plan approval. Ms. Hyson stated that cross -access parking <br />agreement was for employee parking. <br />In response to the Commission's question regarding obtaining a current cross -access parking agreement, <br />Ms. Hyson explained that the restaurant is a permitted use and the conditional use is an accessory to the restaurant <br />use. She said there is sufficient parking on the site. In response to the Commission's question regarding the parking <br />requirements, Ms. Hyson stated the 106 parking spaces listed in the staff report is based on the current Code <br />requirements. She said the parking was approved with the site plan approval and the City cannot alter the parking <br />requirements because there are no alterations being made to the building. <br />Mr. Henson asked the applicant to come forward. Ms. Catherine Chen, 100 Live Oaks Boulevard, <br />Casselberry, Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 17-22. Mr. Phillips made a motion that the Planning and <br />Zoning Commission approve CU 17-22 to allow the sale of beer and wine (2COP) for on-site consumption at 100 <br />
