Planning & Zoning Commission/ <br />Local Planning Agency <br />January 10, 2018 <br />Page 2 <br />A brief discussion ensued regarding eliminating the Planning and Zoning Commission's review of <br />conditional use requests for alcohol sales for a restaurant use. Mr. Henson stated that the state regulates alcohol <br />sales and felt that staff should review this use. Ms. Emily Hanna, Chief Planner, stated that staff is currently <br />reviewing the Land Use Table that regulates conditional, permitted and prohibited uses. She said that staff is <br />reviewing removing the conditional use requirement for alcohol sales in certain zoning classifications. <br />Fifth Item of Business: CU 17-21: 2699 Cassel Creek Boulevard. A conditional use request to serve beer, <br />wine, and liquor (4COP/SRX) for on-site consumption at the Pier 36 Restaurant and Oyster Bar in a CG <br />zoning district. Parcel ID 21-21-30-507-0000-0050 <br />Ms. Christina Hyson, Planner I, reviewed the information provided in her memorandum dated January 10, <br />2018, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). Ms. Hyson said staff recommends the <br />Planning and Zoning Commission approve CU 17-21 to allow the sale of beer, wine, and liquor (4COP/SRX) for on- <br />site consumption at 2699 Cassel Creek Boulevard based on the staff report including the twelve (12) conditions of <br />approval outlined in the staff report. <br />In response to the Commission's question, Ms. Hyson stated that any current code violations are due to the <br />property being vacant and the new tenant would address the violations. <br />Mr. Henson asked the applicant to come forward. Mr. Albert Ayoub, 2699 Cassel Creek Boulevard, <br />Casselberry, Florida came forward. In response to the Commission's question, Mr. Ayoub said that he agrees with <br />the conditions of approval. <br />In response to the Commission's questions, Mr. Ayoub stated that the volleyball area would remain on the <br />site and currently only cosmetic work is being done on the site. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 17-21. Mr. Bryan made a motion that the Planning and <br />Zoning Commission approve CU 17-21 to allow the sale of beer, wine, and liquor (4COP/SRX) for on-site <br />consumption at 2699 Cassel Creek Boulevard based on the findings of fact and conclusions of the staff report dated <br />
