CASSELBERRY CITY COMMISSION <br />Minutes of February 26, 2018 — Regular Meeting <br />Page 6 of 9 <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Chief Planner recommended approval of Ordinance 18- <br />1478 on first reading. <br />Audience Participation: The following individual came forward to address the Commission regarding <br />Ordinance 18-1478: <br />Ms. Tara Tedrow, an attorney with Lowndes, Drosdick, 215 Eola Drive, Orlando, advised she <br />was present on behalf of the applicant, and that the applicant and counsel were in favor of <br />Ordinance 18-1478. <br />No one else came forward to address Ordinance 18-1478. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 18-1478 on first <br />reading, as presented. Motion was seconded by Commissioner Solomon. <br />Motion carried unanimously by voice vote 5-0. <br />11. PUBLIC HEARINGS <br />A. Second Reading of Ordinance 18-1474 — Medical Marijuana Moratorium <br />Extension (LPA 18-01) <br />The City Clerk read Ordinance 18-1474 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, EXTENDING A <br />TEMPORARY MORATORIUM FOR NINETY DAYS; PROHIBITING THE OPERATION OF <br />ANY MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITIES WITHIN <br />THE CITY OF CASSELBERRY, AND THE ISSUANCE OF BUSINESS TAX RECEIPTS, <br />BUILDING PERMITS, DEVELOPMENT ORDERS OR LAND USE/ZONING PERMITS FOR <br />MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITIES WITHIN THE <br />CITY LIMITS IN ORDER TO PROVIDE THE CITY AN OPPORTUNITY TO REVIEW AND <br />ENACT REGULATIONS GOVERNING SAID ACTIVITIES; PROVIDING DEFINITIONS; <br />PROVIDING FOR AN ADMINISTRATIVE REMEDY FOR ASSERTIONS OF VESTED RIGHTS <br />AND PROCESSES AND PROCEDURES RELATING TO SUCH ASSERTIONS; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 18-1474 <br />was advertised in the Orlando Sentinel on Thursday, February 15, 2018. <br />Staff Presentation: Chief Planner Emily Hanna stated Ordinance 18-1474 provides for a 90 -day extension <br />of the City's existing medical marijuana moratorium. She advised that staff was currently working on a <br />new ordinance which was consistent with Senate Bill 8A, and would be bringing that ordinance to the <br />Planning and Zoning Commission in March of 2018. Ordinance 18-1474 was approved on first reading on <br />February 12, 2018. <br />
