CASSELBERRY CITY COMMISSION <br />Minutes of April 9, 2018 — Regular Meeting <br />Page 10 of 16 <br />Development Regulations (ULDR's) to remove language as it relates to exemptions provided to properties <br />having a Future Land Use of Major Thoroughfare Mixed Use (MTMU). <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Chief Planner recommended approval of Ordinance 18- <br />1482 on first reading. <br />Audience Participation: No one came forward to address Ordinance 18-1482. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 18-1482 on first <br />reading, as presented. Motion was seconded by Commissioner Solomon. <br />Motion carried unanimously by voice vote 5-0. <br />B. Ordinance 18-1483 — Amending Article XIV, Tree Protection (LPA 17-09) <br />The City Clerk read Ordinance 18-1483 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING ARTICLE XIV, <br />TREE PROTECTION OF THE CITY CODE OF ORDINANCES, PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, TO MODIFY LANGUAGE AS IT RELATES TO MEMBERS <br />OF THE CTAC, AND MODIFYING TREE BANK PAYMENT LANGUAGE; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Planner Dean Fathelbab gave a brief overview of Ordinance 18-1483, which provides <br />for amending multiple sections of Article XIV, Tree Protection, of the City Code of Ordinances, Part III, <br />Unified Land Development Regulations (ULDR's) to modify language as it relates to members of the <br />Casselberry Tree Advisory Committee (CTAC), and modifying Tree Bank payment language. <br />Discussion: A lengthy discussion ensued relating to details of the proposed ordinance during which staff <br />responded to questions from the Commissioners to clarify various points of the ordinance. The discussion <br />and questions covered various aspects of the ordinance, including: makeup of the Casselberry Tree <br />Advisory Committee (CTAC); whether the community volunteer position was currently filled and how <br />frequently the Committee meets; concerns about elimination of citizen participation in the Committee; <br />potential process or protocols to be followed for allowing Tree Bank funds to be used for plantings on <br />private property; potential institution of a program with specific language to be included as part of the <br />ordinance for second reading; the need for specific procedures detailing responsibilities for maintenance of <br />trees planted on private property using Tree Bank funds; concerns about what would be done in the event <br />of death of the trees or removal of the trees by the property owner; challenges presented for placing canopy <br />trees in areas where utilities are located on public spaces; placement of trees on private property in areas <br />providing mutual benefit to surrounding property owners and the community; concerns about maintaining <br />citizen involvement on the CTAC; process for determining placement of trees on private properties; change <br />to the ordinance vs. settting up protocols for private placement of trees; how to ensure maintenance of <br />privately placed trees in the event of a change of property ownership; possibility of utilizing an existing <br />volunteer to serve a dual office on the CTAC; and requirements in various zoning districts relating to <br />cutting down of trees. <br />
