CASSELBERRY CiTY COMMISSION <br />Minules of March 26, 2018 — Regular Meeting <br />Page 8 of 12 <br />11. FIRST READING OF ORDINANCES <br />A. Ordinance 18-1477 — Amending Section 2-5.3 and Section 5-21.2 as it relates to <br />Pharmacies and Medical Marijuana Dispensaries (LPA 18-04) <br />The City Clerk read Ordinance 18-1477 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE, PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, TABLE 2-5.3, LAND USE <br />BY DISTRICT, TO REGULATE PHARMACIES AND MEDICAL MARIJUANA DISPENSARIES <br />SIMILARLY; AMENDING THE CITY CODE OF ORDINANCES, PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, SECTION 5-21.2, DEFINITION OF TERMS, TO INCLUDE <br />PERTINENT DEFINITIONS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Emily Hanna gave a brief overview of Ordinance 18-1477, explaining <br />that if adopted the ordinance would amend Section 2-5.3, Table 2-5.3, Land Use by District and Section 5- <br />21.2, Definitions, of the City Code of Ordinances, Unified Land Development Regulations to include <br />language as it relates to pharmacies and medical marijuana dispensaries. She then gave a brief history of <br />action the City had taken to date as far as regulation of medical marijuana treatment centers, and explained <br />that the amendments being proposed were in response to state legislation passed mandating how cities and <br />counties may address medical marijuana treatment centers. She also included detailed explanations of the <br />changes which would be made to both the land use and definitions sections. She added that the definitions <br />being presented on first reading would undergo minor changes on second reading to be consistent with <br />recent administrative rules from the Department of Health and suggestions provided by other jurisdictions. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Chief Planner recommended approval of Ordinance 18- <br />1477 on first reading. <br />Audience Participation: No one came forward to address Ordinance 18-1477. <br />City Attorney Reischmann briefly shared some statistics regarding lawsuits which had been filed involving <br />medical marijuana, including challenges of licensing and constitutionality of the legislation. She noted that <br />this litigation could delay or postpone implementation of the legislation and added that there were currently <br />30 retail dispensing locations in the State of Florida at this time and the numbers were steadily increasing. <br />MOTION: Commissioner Solomon moved to approve Ordinance 18-1477 on first <br />reading, as presented. Motion was seconded by Commissioner Hufford. <br />Motion carried unanimously by voice vote 5-0. <br />Ms. Reischmann reiterated that there would be some changes to the definitions for second reading of the <br />ordinance, but it would not change the substance of the ordinance, and all that, all changes would be <br />presented in a way that would allow them to be clearly seen. <br />
