CASSELBERRY CITY COMMISSiON <br />Minutes of March 26, 2018 — Regular Mecting <br />Page 5 of 12 <br />Staff Presentation: Chief Planner Emily Hanna gave a brief overview of Resolution 18-3014, explaining <br />that its purpose was to approve a Development Commitment and Vested Rights Agreement with Mayflower <br />Retirement Center, Inc. and Red Bug Center, LLC pertaining exclusively to educational system impact fees. <br />She advised that Seminole County had recently adopted an ordinance approving a higher Seminole County <br />educational system impact fee schedule, but which allowed each municipality to enter into a vested rights <br />agreement by April 10, 2018 with property owners who wished to pay the former educational impact fee <br />which was much lower than the new rate. She noted that the City Commission had adopted Resolution 18- <br />3013 on March 12, 2018, which provided a process and review criteria necessary for entering into these <br />vested rights agreements. She added that the intent of the vesting agreement was that only the buildings <br />that pull permits within the one-year year time period would be vested, not the whole project specifically. <br />Ms. I-lanna advised that Mayflower Retirement Center, Inc., the property owner, and Red Bug Center, LLC <br />the developer, had submitted an application to vest for educational system impact fees to the City Manager <br />and the Community Development Department on March 6, 2018, the application and exhibits had been <br />reviewed, and approval of Resolution 18-3014 approving the requested Development Agreement and <br />Vested Rights Agreement was being recommended to the City Commission. <br />City Attorney Katie Reischmann advised that Seminole County was considering an amendment to its <br />ordinance to allow two (2) years to pull the building permit and if approved it would most likely apply to <br />the City automatically. However, it was possible that staff would bring the agreement with that amendment <br />back to the City Commission for clarification purposes. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Chief Planner recommended approval of Resolution 18- <br />3014. <br />Audience Participation: No one came forward to address Resolution 18-3014. <br />MOTION: Commissioner Solomon moved to approve Resolution 18-3014, as presented. <br />Motion was seconded by Commissioner Aramendia. Motion carried <br />unanimously by voice vote 5-0. <br />10. PUBLIC HEARINGS <br />A.
