CASSELBERRY CITY COMMISSION <br />Minutes of October 30, 2017 — Special Meeting <br />Page 17 of 23 <br />11. PUBLIC HEARINGS <br />A. Second Reading of Ordinance 17-1469 — Amending Sections of City Code, Chapter <br />86, Utilities <br />The City Clerk read Ordinance 17-1469 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING VARIOUS <br />SECTIONS OF CHAPTER 86, UTILITIES, OF THE CITY CODE OF ORDINANCES, TO <br />ESTABLISH NEW SEWER, RECLAIMED WATER AND WATER FEES AND CHARGES FOR <br />ALL RESIDENTIAL, COMMERCIAL AND MULTIFAMILY RESIDENTIAL SEWER, <br />RECLAIMED WATER AND WATER SERVICE PROVIDED BY THE CITY OF <br />CASSELBERRY; PROVIDING FOR ANNUAL ADJUSTMENTS OF RATES; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 17-1469 <br />was advertised in the Orlando Sentinel on Thursday, October 19, 2017. <br />Staff Presentation: Finance Director Rebecca Bowman gave a brief overview of Ordinance 17-1469 <br />explaining that a utility rate study had been prepared by the City's consultant, Public Resources <br />Management Group, Inc. (PRMG) and the rate study had been presented to the City Commission at first <br />reading of Ordinance 17-1469 on August 14, 2017. She noted that second reading of the ordinance had <br />been originally advertised for September 11, 2017; however, that meeting had been cancelled due to <br />Hurricane Irma and second reading of the ordinance had been re -advertised as a public hearing for October <br />30, 2017. She advised that revisions to the ordinance had been requested by the Commission at first reading <br />regarding the imposition of service charges or trip fees and those changes had been made and the amended <br />ordinance was being presented for consideration at tonight's meeting. She added that the effective date of <br />the ordinance had also been changed due to Hurricane Irma as to utility rates to reflect an initial effective <br />date of January 1, 2018, with subsequent years 2019-2022 being effective October 1St of each of those years. <br />She gave a brief overview of each of the changes proposed since first reading including effective dates, <br />miscellaneous service fees, system development fees and methods of calculation of those fees. City <br />Attorney Reischmann clarified that the effective date for the section relating to impact fees would be <br />amended to February 1, 2018. <br />Public Hearing: Mayor Glancy stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 17-1469. Mayor Glancy opened the floor for public participation. The <br />following individuals came forward: <br />1. Ms. Roberta Nicholson, 1159 Sarah Lane, expressed concern about not having had an <br />opportunity to see the ordinance prior to the meeting and what she felt were already high <br />utility rates in Casselberry. She requested that the item be tabled until more information <br />could be provided to the citizens who would be affected. <br />2. Ms. Laura Gray, 1256 Rolling Lane, spoke in opposition to Ordinance 17-1472. <br />3. Mr. Michael Stanley, 215 Shady Hollow, spoke in opposition to Ordinance 17-1472. <br />4. Mr. Steve Christopher, 1160 Sarah Lane, voiced concerns about the current utility rates <br />being high and felt more explanation was needed as to why they should be raised. <br />
