CASSELBERRY CITY COMMISSION <br />Minutes of October 30, 2017 —Special Meeting <br />Page 15 of 23 <br />"FERTILIZER MANAGEMENT"; REGULATING THE PROPER USE OF FERTILIZERS BY <br />ANY APPLICATOR; PROVIDING LEGISLATIVE FINDINGS; PROVIDING DEFINITIONS; <br />PROVIDING FOR APPLICABILITY WITHIN THE CITY OF CASSELBERRY; <br />ESTABLISHING A PROHIBITED APPLICATION PERIOD; SPECIFYING ALLOWABLE <br />FERTILIZER APPLICATION RATES AND METHODS, FERTILIZER -FREE ZONES, LOW <br />MAINTENANCE ZONES, AND EXEMPTIONS; REQUIRING THE USE OF BEST <br />MANAGEMENT PRACTICES WHICH PROVIDE SPECIFIC MANAGEMENT GUIDELINES <br />TO MINIMIZE NEGATIVE SECONDARY AND CUMULATIVE ENVIRONMENTAL EFFECTS <br />ASSOCIATED WITH THE MISUSE OF FERTILIZERS WHICH HAVE BEEN OBSERVED IN <br />AND ON THE CITY OF CASSELBERRY'S NATURAL AND CONSTRUCTED STORMWATER <br />CONVEYANCES, RIVERS, CREEKS, CANALS, LAKES AND OTHER WATERBODIES; <br />REQUIRING PROPER TRAINING OF COMMERCIAL AND INSTITUTIONAL FERTILIZER <br />APPLICATORS; ESTABLISHING TRAINING AND LICENSING REQUIREMENTS; <br />PROVIDING FOR ENFORCEMENT AND PENALTIES; AMENDING SECTION 2-210 <br />"SCHEDULE OF VIOLATIONS" OF ARTICLE V "CODE ENFORCEMENT CITATIONS" OF <br />CHAPTER 2, "ADMINSTRATION", TO PROVIDE FOR PENALTIES; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Staff Presentation: Natural Resource Officer Marissa Williams introduced Seminole County Watershed <br />Management Principal Environmental Scientist Shannon Wetzel who gave a presentation outlining <br />highlights of both the adopted Seminole County ordinance and the proposed City ordinance relating to the <br />use of fertilizers that included the following components: <br />Fertilizer Ordinance <br />o Seminole County Ordinance adopted on February 28, 2017 <br />o Seminole County Ordinance became effective October 1, 2017 <br />o Public outreach and education program in progress since adoption and currently <br />ongoing <br />o Required by NPDES (National Pollutant Discharge Elimination System) MS4 Permit <br />o Adoption required by 12/31/2013 (additional time had been allowed for time <br />constraints and public outreach programs) <br />o Will allow for TMDL (Total Maximum Daily Load) and BMAP (Basin Management <br />Action Plan) credits <br />ICey Points <br />o Summer restrictions <br />■ Do not use fertilizers containing nitrogen or phosphorus from June 1— <br />September 30 <br />■ Can use fertilizers containing iron and other nutrients, i.e. "Summer Blends" <br />o During the non -restricted season only use 50% or more slow release nitrogen (SRN) <br />■ Increase to 65% SRN in 3 years <br />o Do not use phosphorus fertilizers unless a soil test shows it is needed <br />o Do not use fertilizer within 15' of any waterbody or wetland <br />o No grass clippings or yard debris down the storm drain <br />• Reclaimed Water <br />o Ordinance also addresses reclaimed water <br />o Reclaimed water has varying levels of nitrogen and phosphorus <br />
