CASSELBERRY CITY COMMISSION Minutes of August 22, 2016 —Regular Meeting Page 14 of 17 accrued to $8,950.00. Mr. Woodruff advised that the Code Enforcement Special Magistrate entered an order on July 14, 2016 recommending a reduction of the lien from $8,950.00 to $2,500.00 due to the following findings: 1) the subject property had gone into foreclosure two months after the City's lien was filed; 2) the current owner was not the violator; 3) Counsel for current property owner Fairwinds Credit Union at the time of filing of the foreclosure action had failed to file a lis pendens in the case and due to this oversight the City was unaware of the foreclosure; 4) there have been no further violations on the subj ect property to date; and 5) administrative costs in the amount of $495.12 were paid to the City when the request for reduction was submitted. Budget Impact: Revenue has been budgeted in FY 2016 for Code Enforcement lien payments in the General Fund Violations of Local Ordinances/Code Enforcement revenue account #001-0000-354.20-00. Recommendation: The City Manager and the Interim Community Development Director recommended approval of the Special Magistrate's recommendation to reduce the lien on Case CE -10-02219 from $8,950 to $2,500. Audience participation: No one came forward. MOTION: Commissioner Meadows moved to approve the recommendation of the Special Magistrate to reduce the lien in Case No. CE -10-02219 from $8,950.00 to $2,500.00, to be paid within 60 days or the lien would revert to the original amount. Motion was seconded by Vice Mayor Hufford. Motion carried unanimously by voice vote 5-0. 13. CITIZENS' COMMENTS Mayor Glancy announced persons that wished to make comment or make inquiry on any matter not on the agenda, may request to be recognized during Citizens' Comments. Mayor Glancy announced the rules of decorum. No one came forward. 14. CITY MANAGER'S REPORT A. Procurement Information Report for the period 07/01/2016 through 07/31/2016 The Procurement Information Report for the period 06/01/2016 through 06/30/2016 was included in the agenda packet for the Commissioners' review.
