CASSELBERRY CITY COMMISSION <br />Minutes of August 22, 2016 — Regular Meeting <br />Page 13 of 17 <br />MOTION: Commissioner Aramendia moved to approve the recommendation of the Code <br />Enforcement Special Magistrate to accept the $345.72 already paid to the City <br />for costs and to provide a Limited Release on the lien amount of $5,725 for 1547 <br />Oak Lane (Case No. CE -09-01491). Motion was seconded by Commissioner <br />Solomon. Motion carried unanimously by voice vote 5-0. <br />B. Limited Release of Code Enforcement Lien on 1547 Oak Lane (CE -11-00904) <br />Staff Presentation: Interim Community Development Director Randy Woodruff explained that this item was <br />also a request for a limited release of a code enforcement lien on property located at 1547 Oak Lane. He <br />advised that this was for a violation of overgrowth on the property which occurred in April of 2011 and which <br />was a repeat violation of the case just heard previously. He added that the property was found to be in <br />compliance on November 27, 2013 and the fine had accrued to $47,950.00 at that time. He further advised <br />that on July 14, 2016 the Code Enforcement Special Magistrate had entered an order recommending approval <br />of a limited release of the $47,950.00 lien for the following reasons: the lien was recorded afterthe foreclosure <br />action had been filed; the current owner was not the violator; no subsequent violations have occurred on the <br />property to date; the administrative costs incurred by the City of $345.72 were paid when the request was <br />submitted; the lien would remain in place against the former owners, James Rahe, Sr. and James Rahe, Jr.; and <br />the limited release would enable the current property owner, Bank of America, to sell the property. Mr. Gelety, <br />attorney for property owner Bank of America advised that having a $48,000 lien against the property would be <br />a great hindrance to selling it and he would request that the Commission approve the limited release. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Interim Community Development Director recommended <br />approval of the Special Magistrate's recommendation of providing a Limited Release on the lien amount of <br />$47,950 for 1547 Oak Lane. <br />Audience participation: No one came forward. <br />MOTION: Commissioner Hufford moved to approve the recommendation of the Code <br />Enforcement Special Magistrate to accept the $345.72 already paid to the City <br />for costs and to provide a Limited Release on the lien amount of $47,950.00 for <br />1547 Oak Lane (Case No. CE -11-00904). Code Enforcement Lien Reduction Request — 1531 Seminola Boulevard (CE -10- <br />02219 <br />Staff Presentation: Interim Community Development Director Randy Woodruff gave a brief overview of the <br />request for a code enforcement lien reduction for property located at 1531 Seminola Boulevard stating the <br />original violation had occurred in September of 2010; a $50 per day fine was imposed on December 9,2010; <br />the fine had run until the property was determined to be in compliance on May 16, 2011; and the fine had <br />
