CASSELBERRY CITY COMMISSION Minutes of June 27, 2016 — Regular Meeting Page 12 of 16 zoning districts; - Deletion of original text within Section 2-7.19 Community Residential Homes and replace with text in table in accordance with Florida Statutes Chapter 419; - Identify separation requirements for community residential homes for 1-6 residents and 7-14 residents within the table. - Defines Zoning Districts for each type of community residential home, either as a permitted or as a conditional use as defined, and also establishes distance separations for both types of community residential homes per Florida Statutes Chapter 419; - Table identifies the method of measurement for separation purposes, which in this case is defined from structure to structure. Mr. Woodruff advised that proposed Ordinance 16-1447 was consistent with the City's Comprehensive Plan. Discussion: A brief discussion ensued regarding concerns about the difficulty in determining the function of group homes when they were all grouped together for regulation purposes by the State, and perceived Home Rule violation issues. In response to questions from the Commission, Ms. Reischmann advised that this ordinance addressed only those types of group homes which were regulated by the state and did not address sober homes which were not regulated on a state level. She further advised that she believed there was some legislation to address sober homes and she could research the issue and give an update at the next meeting. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended approval of Ordinance 16-1447 on first reading. Audience Participation: No one came forward to address Ordinance 16-1447, MOTION: Commissioner Solomon moved to approve Ordinance 16-1447 on first reading, as presented. Motion was seconded by Commissioner Meadows. Motion carried unanimously by voice vote 5-0. 11. PUBLIC HEARINGS A.
