Mr. Pieski asked where the $6,690 N arrived from, seemed like 10% was a: xary. Mr. Pieski wanted to learn <br />from the City how it was reduced and what factors. <br />The Special Magistrate advised that Mr. Pieski could make himself available for a continuance to discuss this <br />with the City. <br />Mr. Pieski stated it was a fair and reasonable request to ask the City how that figure was arrived at, other than an <br />arbitrary 10%. <br />Ms. Cocotas advised that the fine of $66,900, typically when the City proposes a lien reduction they ask for a <br />percentage of the fines to capture the City's time that isn't necessarily quantified in the administrative cost. In <br />this case the City is seeking 10% for what amounts to years of dealing with the property owner, from 2008 <br />through the present and that is why the 10% was requested of the fine total. <br />Mr. Pieski advised he had spent close to $4,000 on remediation based upon the fact that he did have a permit <br />from Casselberry, plus countless hours of his own personal time and labor. Mr. Pieski asked if he should bill the <br />City for that, at what percentage. <br />The Special Magistrate advised that he was not there to decide whether Mr. Pieski was in violation or not in <br />2007, that decision had already been made as of May 2008 that there was a violation of City Code for building <br />without a permit. The fine began to accrue and had been accruing for a long time until 2011 when the proper <br />permit was received. <br />Finding of fact: The City in their petition has presented mitigating factors to reduce the lien for CE -07-02311, <br />945 Brydie Ct, there have not been any other violations, the property did come into compliance after receiving <br />the permit, a good amount of money ($4,000) to remediate the problem and there was an erosion problem. The <br />mitigation factors were found to be reasonable in the reduction of the lien, which is a 90% reduction to $6,690. <br />This was recommended (to City Commission) that the lien be reduced to $6,690 plus $950 for a total of $7,640. <br />Overgrown property; ULDR Section 3-10.3 <br />CE -09-01491 1547 Oak Ln <br />Mark Campbell, Lead Code Compliance Officer advised that case number CE -09-01491 located at 1547 Oak <br />Ln for the violation of overgrown property; ULDR Section 3-10.3 was heard at the July 14, 2016 hearing and <br />continued to the August 11, 2016 hearing. After City attorney discussion with the City Manager, the City <br />recommends a Limited Release of the lien be provided. The Bank has paid all administrative cost of $355.72. <br />The lien would still be in place against the former owners, James Rahe Sr. & James Rahe Jr. <br />The Special Magistrate asked if the owners or representatives for 1547 Oak Ln were present. There was no one <br />present. <br />The Special Magistrate asked this case was continued from last month. <br />Vivian Cocotas, City attorney's office advised that the last time this matter was set for hearing, about thirty <br />minutes before the hearing the property owner presented a proposed partial release of the lien.
