not sufficient time to evaluate what �y were seeking, it was jointly agreed continue to August 11, 2016 to <br />give opportunity to review the proposal. <br />The Special Magistrate asked what was the result of the proposal was. <br />Ms. Cocotas advised the result was that the City agreed to the administrative cost and will enter a partial release <br />of lien as to the property but not to the property owner at the code violation were incurred. <br />Finding of fact- The Special Magistrate made a finding in case # 09-01491. This had come before the Board on <br />June 9, 2006 (actual year was 2009) where a finding of violation was ordered and a fine imposed. The lien <br />recorded had accrued to an amount of $5,725. Based on the testimony and representations of counsel from the <br />previous hearing and August 11, 2016 the Special Magistrate recommended a Limited Release of the property. <br />The lien will still stay in place against the former owners, James Rahe Sr. & James Rahe Jr. The City <br />Commission will take action on this matter for a final determination at their next regularly scheduled meeting. <br />NEW CASES <br />Overgrown property; ULDR Section 3-10.3 (C)(1) <br />CE -16-00274 1400 Huntington Dr <br />Mark Campbell, Lead Code Compliance Officer advised that case number CE -16-00274, located at 1400 <br />Huntington Dr <br />For the violation of overgrown/trash and debris; ULDR Section 3-10.3 (C)(1), trash and debris on and around <br />property. Notification date was May 5, 2016, correction date requested was June 6, 2016 found non-compliant, <br />hearing notice date was June 24, 2016. Correction date requested was August 10, 2016 found Non -Compliant. <br />Follow-up inspection was August 11, 2016 found non-compliant. The property was found to be non-compliant <br />on August 11, 2016. The City requests a $50 per day fine if the violation is not brought into compliance by <br />August 25, 2016. <br />The Special magistrate asked if the owner or representative was present for 1400 Huntington Dr. There was no <br />one present. <br />Finding of fact- The Special Magistrate made a finding in case # 16-00274, 1400 Huntington Dr. It was found <br />that the property was in violation of ULDR 3-10.3(C)(1), overgrowth, trash and debris. It was ordered that the <br />property come into compliance by 1pm, August 25, 2016, if there is no compliance that date and time a fine of <br />$50.00 per day, for each day the violation continues. This case will be called up again to the next Code <br />Enforcement Hearing on September 15, 2016 to determine compliance. <br />Parking recreational equipment; ULDR Section 3-10.9 (C) <br />CE -16-00350 224 Triplet Ct <br />Mark Campbell, Lead Code Compliance Officer advised that case number that case number CE -16-00350, <br />located at 224 Triplet Ct for the violation of Recreational vehicle parking; ULDR Section 3-10.9(C), recreation <br />vehicle/trailer parked on the property, not screened from view. Notification date was May 24, 2016, correction <br />date requested was June 6, 2016 found Non -Compliant. Hearing notice date was June 29, 2016, correction date <br />requested was August 10, 2016 found non-compliant. Follow-up inspection was August 11, 2016 found non- <br />compliant. The property was found to be non-compliant on August 10, 2016. The City requests a $50 per day <br />fine if the violation is not brought into compliance by August 25, 2016. <br />91 Page <br />
