Mr. Pieski stated 2007/2008 and he gilt the seawall based upon the permit em Phyllis Wallace. Mr. Pieski <br />differed with Ms. Cocotas about the date Jun and July 2008 of the letter. The letter from Ms. Lipscomb dated <br />January 2008, clearly demonstrated that the permit from Ms. Wallace was already issued. <br />The Special Magistrate stated there was an indication that as of May 2008 Mr. Pieski was found in violation for <br />construction without a permit and asked if Mr. Pieski was aware of that. Mr. Pieski was asked if he recalled <br />being found in violation of the land development code for building without a permit. <br />Mr. Pieski advised he had received a notice from the Code Board and was very confused. <br />The Special Magistrate asked what the notices said. <br />Mr. Pieski stated it was eight years ago, he had no clue but did remember he was getting notices and had the <br />permit from Phyllis Wallace from Casselberry. Mr. Pieski felt there was miscommunication within the City as to <br />whether there was a permit of not. Kelly Brock had stated there was too much fill dirt brought in, which was not <br />allowed per permit, in the 100 year flood plain. <br />Mr. Pieski stated the variance was not unanimous; Mayor Bob Goff agreed with him and thought he should be <br />given a variance, based on Mr. Pieski legally and properly getting a permit from the City of Casselberry but was <br />out voted. <br />The Special magistrate asked out voted for what result. <br />Mr. Pieski stated he was denied the variance. <br />Mr. Campbell stated the City would suggest a continuance as well as having the City Engineer present, at the <br />next available meeting. <br />The Special Magistrate asked if the City was asking for a continuance. <br />Mr. Campbell stated yes. <br />The Special Magistrate advised Mr. Pieski that the City was asking that the matter be continued to the next <br />hearing date, September 15th, 2016 for additional testimony from the City Engineer. <br />Mr. Pieski stated if his request for a complete waiver was going to be granted. Mr. Pieski did not know his <br />specific schedule for the date given. <br />The Special Magistrate advised he would take other cases while Mr. Pieski figured out his schedule. <br />The Special Magistrate asked if Mr. Pieski had anything else to add. <br />Mr. Pieski stated no, other than the fact that he didn't think he was responsible for the City's lack of preparation, <br />he had proper letters showing an approximate timeline and that is why Mr. Pieski wanted a decision on August <br />11, 2016. <br />Mr. Pieski asked if there was anything else from the City. The City had nothing. <br />The Special Magistrate advised that judicial notice of the owners petition that the fine/lien be reduced to zero, <br />the City's recommendation is that the reduction lien be put to $7,640 ($6,690 plus $950 administrative cost. <br />7Page <br />
