The Special Magistrate looked at phc,_ , provided in the PowerPoint presentat <br />Finding of fact -Property was in compliance prior to hearing, no finding made. <br />Disabled inoperable unlicensed vehicles; ULDR Section 3-10.9 F <br />CE -16-00539 780 Bayou Dr <br />Mark Campbell, Lead Code Compliance Officer read the case history into record. Case number is CE -16- <br />00539, violation address: is 780 Bayou Dr, violation was for disabled, inoperable, unlicensed <br />vehicles; ULDR Section 3-10.9. Inoperable/unlicensed vehicle under the carport. Notification date was June 2, <br />2016, correction date requested was June 14, 2016 found non-compliant. Hearing notice date was June 15, <br />2016, correction date requested was July 13, 2016 found non-compliant. The City requests a $50 per day fine if <br />the violation is not brought into compliance by July 28, 2016. <br />The Special Magistrate looked at photos provided in the PowerPoint presentation. <br />Mr. Campbell advised that there has been no contact, it is believed that the previous owner had passed away and <br />it's in a trust and there has been no communication back. <br />The Special Magistrate asked if the vehicle tag was run. <br />Mr. Campbell stated no. <br />The Special Magistrate asked if the owner or representative of 780 Bayou Dr was present. There was no one <br />present. <br />The Special Magistrate stated this is for a flat tire, it's not like the vehicle is on blocks and a previous case the <br />vehicle was clearly in some kind of bad crash, this is for a flat tire and an expired tag. The Special Magistrate <br />also thought a $50.00 per day fine was rough. $50.00 would fix what the problem is and would hate to place a <br />lien for a violation that is so easily fixed. <br />Finding of fact- The Special Magistrate made a finding in case # 16-00539, 780 Bayou Dr. This cause having <br />come before the Special Magistrate, after due notice, having heard testimony under oath, received evidence and <br />considering all arguments it was found that the above property is in violation of ULDR Section 3-10.9 F, <br />unlicensed and/or inoperable vehicles. It was ordered that the property come into compliance by July 28, 2016, <br />if the property remains in violation of that section as of that date a fine of $50.00 per day will be imposed. This <br />case will be heard again on August 11, 2016 to determine whether compliance has been achieved. <br />Swimming pool standards; ULDR Section 3-10.3 <br />CE -16-00132 400 Hibiscus Rd <br />Mark Campbell, Lead Code Compliance Officer read the case history into record. Notification date was June 2, 2016, correction date requested was June 15, 2016 <br />found non-compliant, hearing notice date was June 16, 2016, correction date requested was July 13, 2016 found <br />non-compliant, follow-up inspection was July 14, 2016 found non-compliant. The property was found to be <br />non-compliant on July 13, 2016.
