The violation address is 420 Kentia Rd for violation of disabled, inoperable, unlicensed vehicles; ULDR Section 3-10.9, multiple non -working vehicles on the property, one inoperable vehicle now covered by car cover under the carport, car cover does not constitute compliance. Notification date was January 19, 2016, correction date requested was February 2, 2016 found non-compliant. Hearing notice date was June 16, 2016, correction date requested was July 13, 2016 found non-compliant, follow-up inspection was July 14, 2016 found non-compliant. The property was found to be non-compliant on July 14, 2016. The City requests a $50 per day fine if the violation is not brought into compliance by July 28, 2016. The Special Magistrate looked at photos provided in the PowerPoint presentation. Nathan Johnson, Code Compliance Officer advised that they removed some of the cars but then started bringing them back. Mr. Johnson then described the photos, showing an unlicensed vehicle, and the same vehicle covered with a tarp. Mr. Johnson advised that covering a vehicle does not constitute compliance. The Special Magistrate asked if the owner or representative of 420 Kentia Rd was present. There was no one present. The Special Magistrate asked if there has been any contact with the property owner. Mr. Johnson stated he had spoken to the wife of the tenant and the owner contacted him sometime between December and June just to say she had received the notice. She was going to have the tenants correct the problem. Mr. Johnson advised there have been constant complaints about this property. Finding of fact- The Special Magistrate made a finding in case # 15-01256, 420 Kentia Rd. This cause having come before the Special Magistrate, after due notice, having heard testimony under oath, received evidence and considering all arguments it was found that the above property is in violation of ULDR Section 3-10.9 F, unlicensed and/or inoperable vehicles. It was ordered that the property come into compliance by July 28, 2016, if the property remains in violation of that section as of that date a fine of $50.00 per day will be imposed. This case will be heard again on August 11, 2016 to determine whether compliance has been achieved.
