Nathan Johnson, Code Compliance Officer advised this is a trust property and have made several attempts to get <br />ahold of the property owners who may live in New York. The City is also working with PNC Bank and property <br />preservation company MSI to try to get some of the problems resolved on the property. <br />Vivian Cocotas, City Attorney's office advised that a final judgement has been entered for foreclosure sale as of <br />July 14, 2016, set for August 9, 2016, this is a foreclosure property. <br />The Special Magistrate asked if the owner or representative of 400 Hibiscus Rd was present. There was no one <br />present. <br />Finding of fact- The Special Magistrate made a finding in case # 16-00132, 400 Hibiscus Rd. This cause having <br />come before the Special Magistrate, after due notice, having heard testimony under oath, received evidence and <br />considering all arguments it was found that the above property is in violation of ULDR Section 3-10.3, <br />unlicensed and/or inoperable vehicles. It was ordered that the property come into compliance by July 28, 2016, <br />if the property remains in violation of that section as of that date a fine of $250.00 per day will be imposed. The <br />fine amount is due to the habitual nature of various land development regulations and codes on this property. <br />This case will be heard again on August 11, 2016 to determine whether compliance has been achieved. <br />OTHER BUSINESS <br />The Special Magistrate asked if there was any other business to discuss. <br />There was no other business. <br />PUBLIC COMMENT <br />The Special Magistrate asked if there were any public comments. <br />Cynthia Raper, 224 Triplet Ct had two comments. Reference to a lengthy email sent one month and one day ago <br />regarding code violation on the street where the Mayor resides, on Triplet Dr. Ms. Raper had objection to the <br />fact that when she left the meeting last month (July), Carlos Bauer, one of the Lead Compliance Officer's was <br />taunting. her in the hallway. Ms. Raper asked why her name was disclosed, personally to two people where he <br />had to go out and look at violations. Mr. Bauer said to her "what does it matter, what does it matter". Ms. Raper <br />said on the website it states any code violation that are called in or sent in will be kept confidential. She stated <br />it's obvious this man does not know what confidential means. Additionally he (Mr. Bauer) was the compliance <br />officer for 266 NE Triplet Dr and his song to her in the hallway was, it's really a question up in the air as to <br />whether or not a car is actually disables. <br />The last page of the email and the picture that Mark had on the screen for the disabled vehicle, you would either <br />have to be mentally incompetent or blatantly stupid, not to realize that a car with the front bumper hanging off <br />and plants growing out of the engine was not disabled. Ms. Raper stated she was also told that Mr. Bauer <br />personally went out and checked and the homeowner had gotten insurance and brought the registration up to <br />date. Ms. Raper stated that was literally impossible because the vehicle has sat in the driveway for three years, <br />unregistered. There was a picture of the vehicle tag, zoomed in of the yellow registration and she called <br />Tallahassee twice on July 14th, assured her that that was not a vehicle that was in compliance. Mr. Bauer should <br />have clearly seen that instead of flirting with the woman. If he was doing his job he would have clearly seen that <br />the registration did not match tag on the car. <br />Ms. Raper thought Mr. Bauer should be reprimanded and be told to do his job a little bit more thoroughly and <br />not taunt the neighbors and citizens in Casselberry with whether or not he will disclose people's information <br />when he goes out on violations. <br />91 Page <br />
