Finding of fact- The Special Magistrate made a finding based on evidence, photographs and testimony for case <br /># CE -15-00042, 250 Aurora Cir. This cause having come before hearing on February 11, 2016, after hearing <br />evidence it was found that the property was in violation of ULDR Section 3-10.3, general maintenance. The <br />property was ordered to be brought into compliance by 1pm, July 13, 2016. The property was still in violation <br />as of July 14, 2016 and the fine of $50.00 per day imposed, for each day the violation exists. <br />General maintenance., ULDR Section 3-10.3 <br />CE -15-00945 441 Jasmine Rd <br />Mark Campbell, Lead Code Compliance Officer advised that at the June 9, 2016 hearing the Special Magistrate <br />found this property to be in violation and a date of July 13, 2016 was given for compliance or a $50 per day fine <br />would be imposed. The property was found in compliance on June 16, 2016. The City requests no fine be <br />imposed. <br />The Special Magistrate asked if the owner of 441 Jasmine Rd was present. There was no one present. <br />The Special Magistrate looked at photos provided in the PowerPoint presentation. <br />Finding of fact- The Special Magistrate made a finding in case # 15-00945, 441 Jasmine Rd. This matter had <br />come before the Special Magistrate on June 9, 2016 for a violation of ULDR Section 3-10.3 and a violation was <br />found. An Order to comply by 1 pm July 13, 2016, based on the testimony and evidence entered it appeared that <br />as of June 16, 2016 the property was now in compliance and no fine was imposed. A standing order was <br />ordered to be in effect for five years for any repeat violations of the same code. <br />General maintenance; ULDR Section 3-10.3 <br />CE -15-01181 400 Hibiscus Rd <br />Mark Campbell, Lead Code Compliance Officer advised that at the June 9, 2016 hearing the Special Magistrate <br />found this property to be in violation and a date of June 23, 2016 was given for compliance or a $50 per day <br />fine would be imposed. A follow-up inspection was conducted on July 14, 2016 and the property was found to <br />be non-compliant. The City requests that the $50 per day fine be imposed. <br />The Special Magistrate looked at photos provided in the PowerPoint presentation. <br />The Special Magistrate asked if the owner of 400 Hibiscus Rd was present. There was no one present. <br />Finding of Fact- The Special Magistrate made a finding that this case #15-01181 had come before him on June <br />9, 2016 for violation of ULDR Section 3-10.3. After hearing testimony and receiving evidence, a finding of fact <br />was issued and conclusions of law. The property 400 Hibiscus Rd was in violation of the aforementioned code. <br />It was ordered that property be brought into compliance by 1pm on June 23, 2016. Based on testimony and <br />photographs entered into evidence it was found that as of July 14, 2016 the property still has not come into <br />compliance, therefor it was ordered that a fine of $50.00 per day starting as of July 14,2016 and will run <br />continue every day the violation continues to exist. <br />Accessory structure maintenance; ULDR Section 3-10.3 A(6) <br />CE -15-01224 400 Hibiscus Rd <br />Mark Campbell, Lead Code Compliance Officer advised that at the June 9, 2016 hearing the Special Magistrate <br />found this property to be in violation and a date of June 23, 2016 was given for compliance or a $50 per days <br />--- 2 1 Page <br />
