Planning & Zoning Commission/ <br />Local Planning Agency <br />November 9, 2016 <br />Page 3 <br />Zoning Commission approve CU 16-16 to allow a fixed residential boat dock at 546 Queens Mirror Circle. He said <br />staffs recommendation is based on the findings of fact and conclusions of the staff report dated November 9, 2016, <br />and the four (4) conditions of approval outlined in the staff report. <br />In response to the Commission's question, Mr. Fathelbab said that the applicant received conditional use <br />approval for a floating boat dock in April, 2016 and the contractor built the dock. He said the contractor never picked <br />up the permit from the City which resulted in violating one of the conditions of approval; therefore, the conditional use <br />was null and void. Mr. Fathelbab said that the owner was not satisfied with the floating dock and has requested a <br />second conditional use for a fixed dock. <br />Ms. Campbell said the staff report list the address as 546 Queens Mirror Place and it should be 546 Queens <br />Mirror Circle. <br />Mr. Bryan asked the applicant to come forward. Mr. Moacir Menezes, 546 Queens Mirror Circle, <br />Casselberry, Florida came forward. There were no questions for the applicant. A brief discussion ensued regarding <br />the original dock floating down to the neighbor's house during the hurricane. <br />Mr. Bryan asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Bryan asked for a motion to address CU 16-16, Ms. Campbell made a motion that the Planning and <br />Zoning Commission approve CU 16-16, to allow a fixed residential boat dock at 546 Queens Mirror Circle based on <br />the findings of fact and conclusions of the staff report dated November 9, 2016, and the conditions of approval <br />outlined in the staff report including attachments A - D. Mr. Weinroth seconded the motion. The motion passed <br />unanimously by voice vote. <br />Seventh Item of Business: SPR 16.15: Commercial Retail Store (09-21-30-5BM-OB00-0220, 09.21-30-5BM- <br />OB00-0230 and 09-21-30-5BM-OBOO-0240). A Major Site Plan Review for the development of a commercial <br />retail store located at the northeast corner of Seminola Boulevard and Lake Drive. <br />Ms. Emily Hanna, Planner II, reviewed the information provided in staffs memorandum dated November 9, <br />2016, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />presentation is attached and made a part of the minutes).
