rTCPrz't <br />T. -t Spacc <br />Reva d <br />Hmdicap Space <br />57A l l' RIiC0.1 f1ILN1� 9 `l'IOArS: <br />Staff recommends the Planning and Zoning Commission approve the requested conditional <br />use, CU 16-14, to serve beer and wine (2COP) for property located at 4275 South US <br />Highway 17-92. Staff approval is based on the findings of fact and conclusions of this staff <br />report dated October 14, 2016, and the following conditions: <br />1. The subject property is nonconforming due to inadequate parking facilities; the existing <br />building can only park one restaurant. As such, future retail uses shall become nonconforming <br />due to parking deficiencies. <br />2. The applicant shall provide one (1) ADA compliant parking space. <br />3. There shall be no outside sales, storage, or display of goods, materials or services. <br />4. The conditional use shall commence within 90 days of the approval, <br />5. The conditional use shall expire if the use is discontinued for mom, than 90 days and/or if <br />the applicant does not secure a business tai license from the City within this timet arae. <br />6. All of the above conditions shall be fully and faithfully executed or the conditional use shall <br />become null and void. <br />10/13/2016 <br />MIVDI7IOAAL GSE CRIIERLI <br />1. Land use compatibility. The proposed use is compatible with the surrounding land uses, <br />Zoning, and Future Land Use Designation. <br />2. Sufficient site size and adequate site specifications to accommodate the proposed use. <br />Based on the existing lira=ted occupancy of the building, there are enough parking spaces <br />available to accommodate the parking requirements ofthe Casselberry Grill even though the <br />parkingspaces are undersized. <br />3. Properuse ofmitigative techniques. <br />Parking - The Casselberry Grill currently occupies a space of approximately 1,150 <br />square feet. Per 5ection 3-15.2, the Casselberry Grill is required to provide a minimum <br />of eleven (11) parking spaces. This property is also required to have at least one (1) <br />ADA compliant parking spaced, this requirement shall be a condition of this approval. <br />The plaza has a total of fifteen (15) parking spaces. Upon the addition of one (1) ADA <br />compliant parking space, this site shall provide adequate parking to accommodate the <br />Casselberry Grill. <br />4. Hazardous waste. Any hazardous wastes generated by this use are required to be stored and <br />disposed of according to state and federal laws. There will be no outdoor storage of <br />hazardous wastes. <br />S. Compliance with applicable laws and ordinances. Possession of both City and County <br />business tax receipts, as well as any applicable permits, licenses and inspections from other <br />agencies must be obtained prior to implementingthe use. <br />GRA Redevelopment Plan Update <br />
