Planning & Zoning Commission/ <br />Local Planning Agency <br />July 13, 2016 <br />Page 6 <br />dated July 13, 2016, subject to the waiver request and conditions of approval as listed in the staff report and the following <br />recommendations: <br />1. That the applicant work towards relocating the dumpster to the southwest part of the property so that it is away <br />from Plumosa Avenue. <br />2. The applicant and the City work on a no left hand turn structural device in the roadway for exiting on to Plumosa <br />Avenue. <br />3. There is a proper walkway through the shrubbery for the drive thru staging area. <br />Mr. Bryan seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: CU 16-10: South US Highway 17-92 (08.21-30-536-0000.0020). Conditional use request to <br />build and operate a drive- thru located at the proposed Culvers within the Cambridge Oaks shopping plaza outparcel. <br />Mr. Dean Fathelbab, Planner I, reviewed the information provided in staffs memo memorandum dated July 13, 2016, <br />and a PowerPoint Presentation to the City of Casselberry Planning and Zoning Commission (a copy is attached and made a <br />part of the minutes). Mr. Fathelbab reviewed Addendum A that was distributed to the Planning and Zoning Commission (a <br />copy is attached and made a part of the minutes). <br />Mr. Fathelbab said staff recommends the Planning and Zoning Commission approve CU 16-10, conditional use for a <br />drive-thru, for the property located at South US Highway 17-92. He said the approval is based on the findings of fact and <br />conclusions of the staff report dated July 13, 2016, and the six (6) conditions listed in the staff report. The conditions of <br />approval are: <br />No more than twenty (20) parking spaces shall be substandard (9'x18'). <br />All applicable licenses and permits shall be obtained prior to the commencement of any construction activities at <br />the site. <br />All signage require a separate permit and must comply with the ULDR's. <br />There shall be no outside sales, storage, or display of goods, materials or services. <br />A new conditional use application shall be required if the use of the drive -up window should cease for more than <br />ninety (90) days. <br />All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />The applicant came forward to answer the Planning and Zoning Commission's questions. Mr. Jeremiah Bowe, 8138 <br />1831d Street, Chippewa Falls, Wisconsin came forward. Mr. Bowe reviewed the location of the drive thru speaker box. A brief <br />discussion ensued regarding the noise levels at the property line and the condition of approval restricting outside sales. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Ms. Brenda Monger, 15 Plumosa Avenue, Casselberry, Florida came forward. Ms. Monger expressed a concern with <br />the noise generated from the speaker box for the drive-thru. Ms. Monger requested a copy of the sound level information that <br />was provided to the Planning and Zoning Commission. <br />
