Ms. Hanna said staff requests the Planning and Zoning Commission review the Development of <br />Community Impact site plan application for Culvers (SPR 16-10) and provide a recommendation to the City Commission. She <br />said the recommendation is based on the site plan dated June 28, 2016, the staff report dated July 13, 2016 and subject to <br />the following waiver request and conditions listed in the staff report. <br />Waiver Requested: <br />Waiver requested for Section 3-15(6)(A) for 40% of the parking stall sizes to be reduced from 10'x20' to 9'x18'. Staff <br />supports a modification for 9'x18' stalls for up to forty percent of total spaces provided (20 spaces total). The <br />remaining 27 parking spaces will be standard size at 10'x20' and two (2) spaces will be 12'x20' and ADA compliant. <br />Conditions of Approval: <br />1. DRC comments, from the May 12, 2016 meeting shall be addressed prior to City Commission review. <br />2. All utility lines shall be placed underground (Section 3-10.2 (4)). <br />3. All Public Works issues must be addressed prior to issuance of a site construction permit. <br />4. All required local, regional, state and federal permits shall be obtained before commencement of development. <br />5. The applicant shall provide a photometric plan that conforms to the ULDR requirements prior to issuance of a <br />Certificate of Occupancy. <br />6. The property shall pass landscaping, irrigation, and photometric/lighting inspections prior to completion of the <br />project or issuance of a Certificate of Occupancy. <br />7. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to the <br />expiration of this approval. <br />8. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and void. <br />A brief discussion ensued regarding the agenda order. Mr. Henson asked the applicant to come forward. Mr. <br />Jeremiah Bowe, 8138 1831d Street, Chippewa Falls, Wisconsin came forward. In response to the Commission's question, Mr. <br />Bowe said that he has read and agrees with the conditions of approval. <br />In response to the Commission's question regarding the percentage of drive thru sales, Mr. Bowe said that number <br />varies greatly by location but the system average is between 35 — 45%. <br />Mr. Henson stated that the Planning and Zoning Commission is in receipt of a petition that has been signed by 94 <br />residents (a copy of the petition was included in the agenda packet). <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Ms. Brenda Monger, 15 Plumosa Avenue, Casselberry, Florida came forward. Ms. Monger expressed a concern with <br />the increased traffic to the area. She felt that a professional office would be better suited for the site. <br />Ms. Monger stated that the petition has 94 signatures but felt she would have more signatures had it not been a <br />holiday weekend. Ms. Monger questioned the number of Culver Restaurants that are located across the street from <br />residential. <br />
