REDUCTION REQUEST
Fence maintenance; ULDR Section 3-10.3(B)
® CE -12-00329 620 Crestview Dr
Carlos "Mike" Bauer, Lead Code Compliance Officer advised that the City's position was that a lien reduction was
entertained, however an inspection revealed there was work being done without a permit for a roof. The City withdrew the
case and would hear at a future date.
The Special Magistrate asked if the owner for 620 Crestview Dr was in the audience. There was no one present.
FINDING OF FACT: The Special Magistrate made a fording in case # 12-00329 to grant the request to withdraw this
case. No action was taken.
NEW CASE
General maintenance; ULDR Section 3-10.3
® CE -15-00859 1175 Galahad Dr
Carlos "Mike" Bauer, PT Lead Code Compliance Officer advised that this property was fust inspected by the City on
October 30, 2015 by Officer Nathan Johnson. A violation of ULDR Section 3-10.3 was found. Mr. Bauer read the Code
into record. The property was found to be Non -Compliant on March 9, 2016; the City requests a $50 per day fine if there
is no compliance by March 24, 2016. The property owner has spoken to the Building Official and is in the process of
having a contractor apply for the permit.
Mr. Bauer advised that the owner has made attempts to comply but is still in violation of 3-10.3, the officer's position is a
30 day grace period should be allowed so that the owner can achieve obtaining a building permit, then at that time a $50
per day fine would be imposed should there be no compliance. The owner has made a good faith effort and the City would
like to grant the 30 day grace period.
The Special Magistrate asked if the City wanted to pick a different date as March 24, 2016 is not 30 days out.
Mr. Bauer advised that in speaking with the Officer it was 30 days from March 10, 2016 to be given.
The Special Magistrate asked if giving the same compliance date as the April 2016 hearing would be ok with the City.
Mr. Bauer stated the City would follow the Special Magistrates lead.
Deborah Moyer 2205 Hunterfield Rd, Maitland FL 32751 gave testimony. Ms. Moyer stated she is happy to comply and
one of the issues here is she had taken the work of her tenant that it was fixed. The particular paper stated there was
untreated wood holding up the front end of the porch, so when that was replaced Ms. Moyer thought she was good. There
was then some further discourse between the other Code Compliance officer and her tenant, it was requested that this not
happen again. If Ms. Moyer is going to be fined, she wants to talk and get it resolved.
Ms. Moyer spoke with Debra Arnold and Dale on March 10, 2016 and she wanted to make sure she was doing the right
thing, so when she brings it (the permit application) she has everything she needs. There is a contractor who would be
happy to fill the application out and the April date should not be a problem. Ms. Moyer wanted to make sure the steps she
was taking are correct, the contractor would fill out the application and would need the State license, BTR and insurance
to the City.
The Special Magistrate advised that was for the City to figure out.
Brenda Jones Code Compliance secretary advised that Ms. Moyer had left before Debra Arnold had come back and plans
may be needed, structural plans showing how they are anchored. It was advised that Ms. Moyer call Debra Arnold
Monday to discuss if plans are needed.
2 1 P a g e
