CITY OF CASSELBERRY <br />CODE ENFORCEMENT HEARING <br />MARCH 10, 2016 <br />The City of Casselberry held its regular Code Enforcement hearing Thursday, March 10, 2016, at 6:30 p.m., in the City of <br />Casselberry Commission Chambers, 95 Triplet Lake Drive, Casselberry, Florida. Luis R. Guzman, Special Magistrate, <br />called the meeting to order at 6:30 p.m. <br />SPECIAL MAGISTRATE <br />Luis R. Guzman <br />PLEDGE OF ALLIGIANCE <br />SWEARING IN OF THOSE IN ATTENDANCE <br />The Special Magistrate swore in those who would testify. <br />FORMAT FOR PROCEEDINGS <br />The Special Magistrate read the format for proceedings. <br />APPROVAL OF MINUTES <br />The Special Magistrate approved minutes from the February 11, 2016 hearing. <br />CITY STAFF PRESENT <br />Randy Woodruff, Development Services Manager <br />Mark Campbell, Lead Code Compliance Officer <br />:arlos "Mike" Bauer, PT Lead Code Compliance Officer <br />Brenda Jones, Code Compliance-Coordinator/Recording Secretary <br />STATEMENT OF EVIDENCE <br />Carlos Miguel "Mike" Bauer, Lead Code Compliance Officer advised that all events occurred within the corporate limits <br />of the City of Casselberry. The Officer's notes, case narratives, testimony, photographs, supporting documents and <br />PowerPoint presentation were all entered as part of the official record. <br />SUBSEQUENT CASE <br />Temporary Structures, ULDR Section 2-7.9 (A) (6) (A) (2) <br />• CE -15-00826 1281 Seminola Blvd <br />Carlos "Mike" Bauer, PT Lead Code Compliance Officer advised that evidence photos and the conclusion is this case <br />came before the Special Magistrate on February 11, 2016. The properly was ordered to be in compliance by February 25, <br />2016 or a $50 per day fine would be imposed. An inspection was performed on February 25, 2016, the inspection was <br />completed and the violation found to be corrected. The City's position is due to compliance being achieved no fine should <br />be imposed. <br />FINDING OF FACT: The Special Magistrate made a fmding in case # 15-00826 based on testimony and evidence, this <br />case came for hearing February 11, 2016. There was a finding of violation and an order that the property come into <br />compliance by February 25, 2016 or receive a $50 per day fine that would be imposed. It was found that the violation was <br />corrected by the date ordered of February 25, 2016; therefore no fine should be imposed. A standing order was entered to <br />be in effect for five years for any repeat violations of the same code, a fine of $500 per day could be imposed for repeat <br />violations. <br />I I P a g e <br />
