The Special Magistrate stated the City would have to see the other violations from a vantage point because you <br />are not allowed to go onto the property without the owner's permission and asked if that was correct.. <br />Mark Campbell stated yes. <br />The Special Magistrate asked if there was anything from anyone else. <br />The Special Magistrate asked to see the picture dated June 9, 2016 and if there was a picture of the whole <br />property. <br />Mark Campbell advised as far as the report of waste water, there is an ongoing case with the health department. <br />As far as the City is concerned this is all there was. <br />The Special Magistrate asked for Ms. Raper to come back up to the microphone. Ms. Raper was asked if the <br />photo dated May 24, 2016 was the way it looked June 9, 2016. <br />Ms. Raper stated yes and asked why waste water coming out of the wash not a code violation for the City. <br />The Special Magistrate stated she would have to ask the City. <br />Ms. Raper stated they would be asking that under deposition. <br />The Special Magistrate stated if there are other things going on, she would need to ask the City. Ms. Raper is <br />free to take pictures as evidence, just like the City presents evidence. <br />Ms. Raper asked why is it that certain people get singled out by the City for Code Compliance problems when <br />here is a former City Commissioner and County Employee who has never been cited for the fact he has four <br />out buildings with no permits and approx. 15-20 chickens and ducks which run around and poop and urinate on <br />other people's property but because he is a friend of the Mayor and former City Commissioner he has never <br />been cited. Ms. Raper wanted to get that on the record. <br />Finding of Fact- Based on testimony and evidence presented it was found that the property 224 Triplet Ct was <br />in violation of City Code Section 58-162, Public Nuisance, however the violation was corrected as of May 24, <br />2016. A Standing Order was entered, if this property is found to be in violation of the same code section, that <br />violation would be treated as a repeat violation. If the violation is found within five (5) years from the date of <br />the order and a fine of up to $500 per day for each day the violation exists. In a photograph dates May 24, 2016 <br />it depicts the property, 224 Triplet Lake Ct (actual address is 224 Triplet Ct) CE -15-01277, there is no violation <br />in the photograph, per the undisputed testimony that is the way the property looks as of June 9, 2016. As of June <br />9, 2016 there is no violation, if there is something else, some other photograph or corroborating testimony other <br />than what was said then that could be another violation, including the Public Nuisance mentioned. Public <br />Nuisance can mean other things, but there was no evidence of the other things going on. The Special Magistrate <br />stated he was bound by what was presented to him.
