On May 24, 2016 the property was found to be in compliance, when the water service was reinstated after <br />repairs were made to the septic system. The City requests a Standing Order for any future violation of the same <br />code, due to the violation not being corrected by February 24, 2016, the date given for correction on the Notice <br />,ent February 18, 2016, however no fine should be imposed at this time. <br />The Property was cited for raw sewage spilling out onto the front yard of the property. The raw sewage was <br />treated and removed from the property and a permitted septic tank and drain field was installed. The property is <br />compiled as of 5/24/16. -- The City is requesting a Finding of Fact that the property was in violation and a <br />Standing Order in so that any occurrence of the same violation by the Respondent(s) on the same property <br />within the next (5) years, be treated as a repeat violation with a fine of up to $500.00 per day. <br />There was a lis pendens on 10/4/12 and a final judgement on 9/21/15. The sale was set for 1/21/16 but did not <br />happen. No further foreclosure information after that. <br />Mark Campbell advised that the tenant was present to speak. The property owner was not present. <br />Cynthia Raper, 224 Triplet Ct stated she has no interest in the property other than her and her husband being the <br />unfortunate tenants who live below the homeowner and the nine family members living with him. There are <br />three cars, all inoperable, two with no tags, one with expired tag. There is also a washing machine that hourly <br />floods the back yard and Ms. Raper wants to know why no citations have been issued for those four violations. <br />Ms. Raper stated the property will be sold if anyone bothered to check toe docket, on the 28th of June. <br />The Special Magistrate asked Ms. Raper if the property owner was in the audience. <br />Ms. Raper stated no. <br />i he Special Magistrate stated Ms. Raper has mentioned a docket. <br />Ms. Raper stayed yes, the docket where you check for foreclosures, civil and criminal cases. The house gets <br />sold on the 28th of June. The house has been in foreclosure for four and a half years. The violation mentioned <br />above was stated again. There is a back porch which is holding up a potatoes sack, which is a covering for the <br />back porch. <br />Ms. Raper stated she knows Nathan saw this violation because he and the Building Official, Dale Baker had to <br />go to the back of the house to get the owner to open the door, they did not want to come out in front of the news <br />cameras. Code Enforcement is aware of this and there are mice and snakes getting into an abandoned vehicle <br />which has no tags, sitting in the back yard. <br />The Special Magistrate asked if there was anything else. <br />Mark Campbell stated this is the only case before him today. <br />The Special Magistrate stated this is before him as a public nuisance, specifically the septic system. <br />Mark Campbell stated yes. <br />The Special Magistrate stated the tenant has stated there are other violations. <br />✓lark Campbell stated the public nuisance is the only case there is on June 9, 2016. <br />61 Page <br />
