<br />The Special Magistrate asked to verify the photographs dates.
<br />Carlos Miguel "Mike" Bauer, Part time Lead Code Compliance Officer entered into evidence that he did visit
<br />the site for the first time on August 13, 2015, photos were taken. On August 27, 2015 the property was posted
<br />for 3-10, damaged roof and building and 3-10.3 overgrowth. The overgrowth was corrected, the building stayed
<br />status quo. On September 3, 2015 a letter was sent (a notice of violation), on September 9, 2015 the property
<br />owner, Tom Evans called and advised what he wanted to do with his property, to demo and rebuild. More time
<br />was requested, until November 1, 2015, it would be intricate and problematic to get the permit.
<br />On November 7, 2015 permit 15-1206 was posted on the property, which was issued on October 29; 2015. An
<br />inspection was completed on May 11, 2016 after many complaints, the property was still in dereliction, nothing
<br />has been improved, there is a concern of urban blight, graffiti, kids playing in there, and it was therefore
<br />scheduled for Hearing. A 30 day permit was issued, the City wanted to give until July 13, 2016 to finish demo
<br />of the property, cleaning up and bringing it up to a non -violation status. If there is no compliance a $50 per day
<br />fine would be imposed.
<br />The Special Magistrate called to the audience for the property owner or representative of 441 Jasmine Rd. There
<br />was no one present.
<br />Binding of Fact- Based on the testimony and evidence the building is not even 10% standing, it was found to be
<br />a violation of ULDR Section 3-10.3 for case CE -15-00945, located at 441 Jasmine Rd. It was ordered that the
<br />property come into compliance by July 13, 2016 or if the violation is not corrected a fine of $50 per day for
<br />each day the violation continues past July 13, 2016. If Code Enforcement does not find compliance by July 13,
<br />2016 another hearing will be held on July 14, 2016.
