CASSELBERRY CITY COMMISSION <br />Minutes of May 9, 2016 — Regular Meeting <br />Page 9 of 11 <br />A. Procurement Information Report for the Period March 1, 2016 through March 31, <br />2016 <br />Advised that the Procurement Information Report for the period March 1, 2016 through March 31, 2016 was <br />included in the Commission Agenda Packets for this meeting. A copy of the report is attached to and made <br />part a part of these minutes. <br />Advised that the entire Draft Multimodal Transportation Master Plan would be posted on the <br />City's website along with the workshop agenda. He also advised that the Palm Drive concept <br />project for a linear park was not recommended in the Draft Multimodal Transportation Master <br />Plan by staff and the City's consultants, due to lack of available funding. He added that he <br />hoped that would give some comfort to those in the audience with concerns about the project. <br />Clarified that the $15,000 amount listed on the Procurement Report on the line item for <br />consultant Ryan, LLC, was not cash outlaid by the City, but something that would be <br />withheld once the State of Florida converts the City's allowed voluntary cleanup tax credits to <br />cash. <br />Advised that due to the Supreme Court decision on Workers' Comp attorney's fees, rates <br />would escalate and attorneys would be drawn to that area of law as it would now be more <br />lucrative. She stated this would probably be the case until such time as there may be a <br />legislative solution as alluded to by Representative Cortes. <br />Reported that the Supreme Court had also handed down a decision on the Public Records Act, <br />siding with two of the appellate districts which held that there is no good faith exception to <br />the award of attorneys' fees. She noted that in this case the government had a real question as <br />to whether the public records should be provided or not and the trial court held that no <br />attorneys' fees should be awarded to the requestor because of this good faith concern that the <br />government had. However, the Supreme Court held that there was no room for this sort of <br />exception and there is an automatic award of attorneys' fees. She stated that this case made it <br />even more clear how much a legislative solution to the problem is needed. <br />Advised for the record that a City Commission Workshop was scheduled for Monday, May <br />16, 2016 at 3:00 p.m. in the City Commission Chambers at which an overview of the Draft <br />Casselberry Multimodal Transportation Master Plan would be presented. <br />Advised that in accordance with Casselberry City Charter Section 7.06, the qualifying period <br />for candidates for Commissioner Seat Number 4 and Mayor /Commissioner Seat Number 5 <br />would be held from 12:00 p.m. Monday, May 16, 2016 through 12:00 p.m. Friday, May 20, <br />2016 during regular business hours.
