and changes of occupancy approvals as may be required for the proposed use, shall <br />have installed the lighting and security plan elements (including doorway /exit and <br />building perimeter lighting), advanced HVAC and air /odor filtration system, and <br />shall have complied with all other Medical Marijuana Dispensary or Treatment <br />Center regulations set forth in City Code, and shall have been reviewed by various <br />City staff. <br />5. Background Check. Every employee of a Medical Marijuana Dispensary or <br />Treatment Center must undergo a criminal background check through the Florida <br />Crime Information Center and the National Crime Information Center at the time of <br />hire and every annual anniversary of employment. These background checks will be <br />at the expense of the Medical Marijuana Dispensary or Treatment Center <br />Owner /Operator and provided to the City Police Department. It is not permissible for <br />employees of Medical Marijuana Dispensaries or Treatment Centers to have any <br />criminal convictions at the time of their hire or at any point during their employment. <br />If at any point during employment the annual background check reveals a criminal <br />conviction for an employee, said employee must be terminated immediately. <br />6. Prohibited activities. A Medical Marijuana Dispensary or Treatment Center shall <br />not engage in any activity other than those activities specifically set forth in the <br />definitions in Section 2- 7.34(A) as an authorized part of the use. The following <br />activities are specifically prohibited: <br />a. Consumption of any marijuana or marijuana product on -site at any Medical <br />Marijuana Dispensary or Treatment Center. <br />b. Non - medical/ recreational marijuana facilities. <br />c. Smoking, ingesting, or otherwise consuming medical marijuana in the City of <br />Casselberry unless such smoking, ingesting or consumption occurs entirely <br />within a private residence, or within a clinic, health care facility, residential <br />care facility, or residential hospice licensed pursuant to applicable provisions <br />of the Florida Statutes. <br />d. Purchasing, using, smoking, ingesting, offering for sale, possessing, <br />consuming, or carrying any non - medical /medical marijuana in any public <br />park or governmental property or on the public right -of -way, inclusive of <br />streets, sidewalks or alleys, within the City. <br />e. Any other activity or use of the premises, except those specifically authorized <br />as part of the Medical Marijuana Dispensary or Treatment Center approval. <br />7. Performance standards. All Medical Marijuana Facilities shall comply with the <br />following standards, which are considered conditions of approval: <br />Ordinance 16 -1439 <br />Page 7 of 12 <br />
