b. Be accompanied by a lease or letter of intent identifying the specific use, if <br />the Medical Marijuana Facility and the property are not owned by the same <br />person. <br />c. Provide proof to the City that the Medical Marijuana Facility business <br />operator is authorized by the State of Florida to sell medical marijuana to <br />persons authorized by the State of Florida to purchase same for treatment of <br />certain medical conditions. <br />d. Each application for a conditional use shall be accompanied by a conditional <br />use concept plan incorporating these regulations. The plan shall be drawn to <br />scale indicating property lines, rights -of -way, the location of buildings, <br />parking areas, curb cuts and driveways, parking calculations and site lighting <br />and safety and security elements. <br />e. Other standards may be necessary to ensure compatibility with the <br />surrounding area and may be included in the conditional use approval. <br />2. Application fee. A non - refundable Medical Marijuana Facility Application fee asset <br />by resolution of the City Commission, which fee shall be used to defray the costs of <br />the application review process by various offices and departments. <br />3. Location Requirements. <br />a. Facilities shall be located in an I (Industrial) or IM (Industrial Medium) <br />zoning district; <br />b. A 1,500 foot distance separation shall be provided from another Medical <br />Marijuana Dispensary or Treatment Center; <br />c. A 300 foot distance separation shall be provided from a child care center, <br />public, private or parochial school (pre- kindergarten through grade 12), <br />public park, church or residentially zoned land; <br />Where a Medical Marijuana Facility is approved o r located in <br />conformity with the provisions of this Article, the subsequent <br />locating of one of the uses listed in subsections b or c (above) within <br />300 feet of an existing Medical Marijuana Dispensary or Treatment <br />Center shall not cause a violation of this section. <br />d. Distances shall be measured by drawing a straight line between the closest <br />point of the Medical Marijuana Facility to the closest property line or edge of <br />the affected property. <br />4. Inspections and Approvals. Prior to occupancy, following conditional use approval, <br />a Medical Marijuana Dispensary or Treatment Center shall obtain all changes of use <br />Ordinance 16 -1439 <br />Page 6 of 12 <br />
