Section 2 -7.34 - Medical Marijuana Dispensaries and Medical Marijuana Treatment Centers <br />A. Definitions. The following words and phrases defined in this Section and used in this Article <br />shall have the meaning herein prescribed, unless the context clearly suggest otherwise. <br />1. Medical Marijuana Facility: A location that is operated either as a Medical <br />Marijuana Dispensary or a Medical Marijuana Treatment Center. <br />2. Medical Marijuana: Any strain of cannabis, in any form, which is authorized by <br />state law to be dispensed or sold in the state of Florida for treatment of certain <br />medical conditions. <br />3. Medical Marijuana Dispensary: A site, operated by an entity authorized by law and <br />holding all necessary licenses and permits fiom the State of Florida in accordance <br />with local and state laws, that possesses or dispenses marijuana, products containing <br />marijuana, related supplies, or educational materials to qualifying patients or their <br />personal caregivers for medical use. This definition excludes any cultivation or <br />processing (including development of related products such as food, tinctures, <br />aerosols, oils, or ointments) of marijuana. <br />4. Medical Marijuana Treatment Center: Any entity that acquires, grows, cultivates, <br />possesses, processes (including development of related products such as food, <br />tinctures, aerosols, oils, or ointments), transfers, transports, sells, or distributes <br />medical marijuana, or that administers medical marijuana, products containing <br />medical marijuana, related supplies, or educational materials to qualifying patients or <br />their personal caregivers and is registered by the Florida Department of Health. <br />5. Non- medical/Recreational Marijuana Facilities: Any entity that partakes in the <br />production, growing, cultivation, distribution, purchase, sale, transfer, delivery or <br />any other similar or related use of marijuana, cannabis, cannabis -based products <br />or cannabis plants when such production, growing, cultivation, distribution, purchase, <br />sale, transfer, delivery or any other similar or related use is not associated with any <br />medical purpose or use. <br />B. Medical Marijuana Dispensary and Treatment Center requirements. Medical <br />Marijuana Facilities are subject to the following requirements: <br />1. Conditional Use Approval. A conditional use approval is required in accordance <br />with ULDR Article VI. An application for conditional use approval for a Medical <br />Marijuana Facility shall: <br />a. Be a joint application by the property owner and the tenant, if the <br />Medical Marijuana Facility and the property are not owned by the same <br />person or entity. <br />Ordinance 16 -1439 <br />Page 5 of 12 <br />
