Motion was <br />seconded by Commissioner Sandra T. Solomon and carried <br />unanimously on a 5 — 0 voice vote. <br />11. Resolutions: <br />A. Resolution 08 -1862 —Voluntary Development Commitment— Kingdom Hall, <br />Seminola Boulevard (ZB- 06 -04) <br />The City Clerk read Resolution 08 -1862 by title as follows: <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA TO ENTER INTO A <br />"VOLUNTARY DEVELOPMENT COMMITMENT" WITH THE NORTH <br />CONGREGATION OF JEHOVAH'S WITNESS TO PROVIDE CRITERIA FOR THE <br />USE OF THE PROPERTY LOCATED ON SEMINOLA BOULEVARD, CASSELBERRY, <br />FLORIDA, AS DESCRIBED IN SECTION 2 OF THE "COMMITMENT "; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation by Barbara Lipscomb, City Manager: Resolution 08 -1862 is a Voluntary <br />Development Commitment Agreement that is presented as a condition of the Planning & Zoning <br />Commission for the rezoning of the property located on Seminola Boulevard. The agreement <br />ensures that the property will be developed for church use and a conditional use approval will be <br />required for day care, school or elder care uses. The "place of worship: conditional use approval <br />will cease should the property be transferred to any other entity. <br />Staff Recommendation: Approve Resolution 08 -1862 to authorize the Mayor to execute the <br />Voluntary Development Commitment Agreement with the North Congregation of Jehovah's <br />Witness Church. <br />Audience Input - None <br />MOTION: Moved by Commissioner Sandra T. Resolution 08 -1863 — Legacy Park Site Development Modification (SPR 09 -02) <br />The City Clerk read Resolution 0 8- 1863 by title as follows: <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING A <br />SITE PLAN MODIFICATION FOR FRONT YARD SETBACKS WITHIN THE LEGACY <br />PARK RESIDENTIAL TOWNHOME SUBDIVISION AS PROVIDED HEREIN: <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />
