Ordinance 15 -1417 — Lake Howell Municipal Service Benefit Unit <br />The City Clerk read Ordinance 15 -1417 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, CREATING SECTIONS 78 -1 <br />AND 78 -2, ARTICLE I, GENERAL, OF CHAPTER 78, TAXATION, AUTHORIZING THE <br />INCLUSION OF CERTAIN PROPERTY LOCATED WITHIN THE CITY OF CASSELBERRY IN <br />THE LAKE HOWELL AQUATIC WEED CONTROL MUNICIPAL SERVICE BENEFIT UNIT <br />CREATED AND ESTABLISHED BY SEMINOLE COUNTY, FLORIDA, FOR THE PURPOSE OF <br />PROVIDING AQUATIC WEED CONTROL TO THE LAKE AND CONNECTIVE WATERWAY <br />AREAS WITHIN THE UNIT; PROVIDING IDENTIFICATION OF PROPERTY WITHIN THE <br />CITY OF CASSELBERRY AUTHORIZED FOR INCLUSION IN SAID UNIT; PROVIDING FOR <br />PERIOD OF EFFECTIVENESS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Assistant Public Works Director /City Engineer Kelly Brock gave a brief overview of <br />Ordinance 15 -1417 explaining that Seminole County had been going through a petition process to establish an <br />MSBU (Municipal Services Benefit Unit) to create a special taxing district for aquatic plant management for <br />Lake Howell in order to deal with the Hydrilla problems occurring in the lake. He further explained that Lake <br />Howell is located partially in unincorporated Seminole County and partially in the City of CasselberTy, and in <br />order to fully assess the area it is necessary for the City to go through this ordinance process and the related <br />interlocal agreement which was approved earlier in the Consent Agenda in order to allowthe County to extend <br />that taxing authority to properties that are within the City of Casselberry. Dr. Brock and Ms. Kathy Moore, <br />Seminole County MSBU Program Manager, then addressed questions from the Commission relating to how <br />the petition process was conducted, and how the percentages and tax amounts were assessed for the various <br />properties. <br />Discussion: A discussion ensued relating to details about the MSBU petition and voting process; timeline for <br />the treatments; approximate cost of the treatment and breakdown of the various assessment components; and <br />effectiveness and duration of the treatment. <br />Budget Impact: All costs related to staff time, attorney's fees, advertising and mailing costs are collectively <br />estimated to be less than $5,000, and have been budgeted in the FY 2015 budget. Additional costs will not be <br />incurred as a result of approval of the Letter of Support for the MSBU process. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Ordinance <br />15 -1417 on first reading. <br />Audience Participation: The following individuals came forward to address Ordinance 15 -1417: <br />CommissionerAramendia left the chambers at 4:59 p.m. <br />Commissioner Aramendia returned to the Chanihers at 5:01 p.m. <br />
