CASSELBERRY CITY CONINIISSION Minutes of July 13, 2015 — Regular Meeting Page I1 of 13 Cocoa - $ 175 /hour; Cocoa Beach - $224 /hour; and Ocoee - $225 /hour); paralegal duties and rates; term of the rate agreement; and how the rate could possibly be affected by future inflation. Budget Impact: Funds will be budgeted accordingly in City Attorney services account 4001- 0140 - 514.31 -01 for FY 2016 and future years. Recommendation: The City Manager recommended approval of the rate adjustments for City Attorney services as proposed. Audience Participation: The following individual came forward to address the request for a City Attorney Rate Adjustment: Mr. John Casselberry, 700 South Lost Lake Lane expressed some concerns regarding charging for paralegal services, and was not in favor of automatic annual increases. No one else came forward. Discussion: Additional discussion ensued regarding notification to the Commissioners of any rate increases; evaluation cycles; and initiation date of any increases initiated by the Consumer Price Index. MOTION: Commissioner Meadows moved to approve a rate adjustment for legal services provided by the City Attorney, Catherine Reischmann of the law firm Brown, Garganese, Weiss & D'Agresta, P.A., from $150 /hour to $175 /hour for attorneys and $85 /hour for paralegals effective October 1, 2015, with an automatic increase annually based on the CPI (Consumer Price Index) for the Southeast Regionand rounded up or down to the nearest $5, with the next potential rate increase to be October 1, 2016, and requiring that the Commission be notified if and when any rate increase should come into effect. Motion was seconded by Commissioner Hufford. Motion carried unanimously by voice vote 5 -0. 13. CITIZENS' COMMENTS Mayor Glancy announced persons that wished to make comment or make inquiry on any matter not on the agenda, may request to be recognized during Citizens' Comments. Mayor Glancy announced the rules of decorum. The following individuals came forward: 1. Mr. John Casselberry, 700 South Lost Lake Lane, expressed some concerns about the Police Officers' and Firefighters' Pension Plan, stating he felt the City should review changes to the plan name and various union names which had occurred over the years. 2. Mr. Scott Devine 612 Legacy Park Drive, voiced concerns about the amendments to the Legacy Park Planned Development Master Land Use Plan, noting that the current residents of Legacy Park continued to be interested in updates about planned development in the area.
