CASSELBERRY CITY COMMISSION Minutes of July 13, 2015 — Regular Meeting Page LO of 13 Notice of Public Hearing: The Notice of Public Hearing for Ordinance 15 -1427 was published in the Orlando Sentinel on Thursday, April 30, 2015. Staff Presentation: Development Services Manager Randy Woodruff explained that Ordinance 15 -1427 represented two proposed changes to the existing Legacy Park Planned Development Master Land Use Plan and that in response to the discussions at the Commission meeting, staff had reached out to the applicant and the parties associated with this request and a meeting had been scheduled with them on Wednesday, July 15, 2015. He added that in light of the scheduled meeting, he was asking for a continuance of the first reading of Ordinance 15 -1427 on behalf of the applicant. Discussion: A brief discussion ensued regarding the length of the continuance and whether or not additional advertising would be required. It was agreed the ordinance would need to be re- advertised, and a time certain of the August 10, 2015 Commission meeting would be an appropriate date for the continuance. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended approval of Ordinance 15 -1427 on first reading. MOTION: Commissioner Aramendia moved to continue first reading of Ordinance 15 -1427 to a date certain of August 10, 2015. Motion was seconded by Commissioner Meadows. Motion carried unanimously by voice vote 5 -0. 12. OTHER ITEMS A. City Attorney Rate Adiustment Introduction: This item requests approval of a rate adjustment for legal services provided by the City Attorney, Catherine Reischmann of the law firm Brown, Garganese, Weiss & D'Agresta, P.A., from $150 /hour to $175 /hour for attorneys and $85 /hour for paralegals effective October 1, 2015, with an automatic increase annually based on the CPI (Consumer Price Index) for the Southeast Region and rounded up or down to the nearest $5. Staff Presentation: City Manager Randy Newton advised that the current rate for city attorney services for Ms. Reischmann was $150 per hour which was approved by the City Commission in 2002 and which had not been revised since that time. He explained that the request before the Commission was to increase that hourly rate to $175 per hour, and if desired by the Commission, to authorize a cost of living increase annually based on the Consumer Price Index (CPI) for the Southeast Region that would be rounded up or down to the nearest $5 increment and capped at 2.5 %, and an hourly rate of $85 for paralegal services. Discussion: Discussion ensued relating to Ms. Reischmann's tenure as the City's attorney; the Commission's satisfaction with her performance; how the annual cost of living increase would be calculated; hourly rates for city attorney services in surrounding cities (Longwood - $215 /hour; Oviedo - $155 /hour; Lake Mary - $175 /hour; Sanford - $155 /hour; Winter Springs - $175 /hour; Altamonte Springs — $224 /hour; Cape Canaveral- $175 /hour;
