CASSELBERRY CITY COMMISSION <br />Minutes of November 9, 2015 — Regular Meeting <br />Page 16 of 19 <br />DATE." <br />Notice of Public Hearing: The Notice of Public Hearing for Ordinance 15 -1430 was published in the <br />Orlando Sentinel on Thursday, October 29, 2015. <br />Staff Presentation: Planner Emily Hanna gave a brief overview of Ordinance 15 -1430 stating that, if <br />adopted, the ordinance would restrict the sales of dogs and cats to animal rescue organizations, animal shelters <br />and individuals who rear and sell dogs on their property. She added that the ordinance included definitions for <br />animal rescue organization and animal shelter and noted that these types of facilities could operate in or in <br />connection with a pet store or other retail establishment. She noted that the restrictions contained in this <br />ordinance were not covered by Chapter 20, Animals and Fowl ofthe Seminole County Code of Ordinances and <br />these regulations would be enforced by City staff through code enforcement action. She advised that no <br />changes had been made to Ordinance 15 -1430 since first reading on October 12, 2015 and she was available <br />for questions should the Commission have any. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption of <br />Ordinance 15 -1430 on second reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 15 -1430. The following <br />individuals came forward: <br />1. Mr. Eric Davies, owner of Petland Orlando South at 3920 South Semoran Boulevard, stated <br />he had owned his business for 19 years and was in good standing with Orange County Animal <br />Control, the American Kennel Club (AKC) and the United States Department of Agriculture <br />(USDA). He added he goes to great lengths to ensure that his puppies are healthy and come <br />from reputable breeders. He opposed the proposed Ordinance 15 -1430, as he felt it could <br />have a negative effect on his family owned business even though it was not physically located <br />in the City of Casselbeny. <br />2. Mr. Ben Hoofnagle, 12121 Shadowbrook Lane, Orlando, stated he also was also a Petland <br />owner and agreed with Mr. Davies that care of the animals was very important to him and the <br />way his and Mr. Davies' businesses are operated take the welfare of animals very seriously. <br />He stated he was also in opposition to Ordinance 15 -1430, as he agreed it could be <br />detrimental to his business. He invited anyone who wished to come into either of these <br />businesses to get the facts about how they are run. He added that he felt it was dangerous to <br />enact bans not based on facts. <br />3. Ms. Carla Wilson, 702 Heather Lane, Winter Springs, spoke in favor of Ordinance 15 -1430, <br />thanking the Commission for considering the ban on retail sale of dogs and cats and stating <br />that local shelters and rescues were bursting at the seams with healthy animals for adoption <br />and retail pet stores were not needed. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 15 -1430. <br />MOTION: Commissioner Meadows moved to adopt Ordinance 15 -1430 on second and <br />final reading, as presented. Motion was seconded by Vice Mayor Solomon. <br />
