WHEREAS, the City Commission finds that it is essential to protect and preserve <br />the aesthetics, the environment and the public health, welfare and safety of the City and its <br />citizenry, and that it is in the City's best interest, and that it is consistent with the <br />Comprehensive Plan for the City to study the potential impact of pawn shops, tattoo <br />parlors, body piercing salons, and used automotive sales uses within the Moratorium area; <br />and <br />WHEREAS, the City Commission, after holding a public hearing, finds that it is <br />appropriate to impose a temporary moratorium on the licensing and permitting of <br />businesses operating pawn shops, tattoo parlors, body piercing salons, and used <br />automotive sales; and <br />WHEREAS, pursuant to law, an advertisement no less than two columns wide by <br />10 inches long was placed in a newspaper of general circulation notifying the public of this <br />proposed ordinance and of the Public Hearing to be held in the City Commission <br />Chambers, City Hall, in the City of Casselberry at least seven (7) days after the day the first <br />advertisement was published; and <br />WHEREAS, a second advertisement no less than two columns wide by 10 inches <br />long was placed in the aforesaid newspaper notifying the public of the second Public <br />Hearing to be held at the adoption stage at least five (5) days after the day the second <br />advertisement was published; and <br />WHEREAS, public hearings were held pursuant to the published notices described <br />above at which hearings the parties in interest and all others had an opportunity to be and <br />were, in fact, heard. <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of <br />Casselberry, Florida: <br />SECTION 1. FINDINGS. The City Commission adopts the foregoing findings. <br />(a) The purpose of this Ordinance is to enable the City of Casselberry sufficient <br />time to review, study, hold public hearings, and prepare and adopt an amendment or <br />amendments to the City of Casselberry Unified Land Development Regulations, relating to <br />the issuance of any business tax license, permit, conditional use approval, site plan <br />approval and any other official action of the City of Casselberry within the Moratorium area, <br />as defined in Section 3 below. The City will not take any action on any application or issue <br />any business tax license, permit, conditional use approval, site plan approval and any other <br />official action within the Moratorium area, except as provided in this Ordinance. <br />(b) It is further the purpose of this Ordinance to fulfill the City's constitutional <br />charge and statutory obligations to protect and preserve the environment and the public <br />Ordinance 09 -1302 <br />Page 2 <br />
