ORDINANCE NO. 09 -1302 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />IMPOSING A TEMPORARY MORATORIUM FOR 175 DAYS ON <br />THE ISSUANCE OF ANY BUSINESS TAX LICENSE, PERMIT, <br />CONDITIONAL USE APPROVAL, SITE PLAN APPROVAL AND <br />ANY OTHER OFFICIAL ACTION OF THE CITY OF <br />CASSELBERRY HAVING THE EFFECT OF PERMITTING OR <br />ALLOWING THE CONSTRUCTION AND /OR OPERATION OF <br />CERTAIN BUSINESSES WITHIN THE CITY OF CASSELBERRY, <br />COMMONLY REFERRED TO AS PAWN SHOPS, TATTOO <br />PARLORS, BODY PIERCING SALONS, AND USED <br />AUTOMOTIVE SALES, AS MORE SPECIFICALLY DESCRIBED <br />IN THIS ORDINANCE, EXCLUDING APPROVALS AND <br />PERMITS FOR THE CONTINUANCE OF AN EXISTING <br />BUSINESS; THE TEMPORARY MORATORIUM SHALL APPLY <br />TO ALL REAL PROPERTY LOCATED WITHIN THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY; <br />PROVIDING A PROCEDURE FOR EXTRAORDINARY <br />HARDSHIP; PROVIDING FOR SEVERABILITY, CONFLICTS, <br />AND AN EFFECTIVE DATE. <br />WHEREAS, numerous pawn shops, tattoo parlors, body piercing salons, and used <br />automotive sales businesses have located within the city limits; and <br />WHEREAS, there is a strong likelihood that pawn shops, tattoo parlors, body <br />piercing salons, and used automotive sales will proliferate throughout the City causing a <br />decrease in property values and threatening the aesthetics of the City, thus threatening the <br />public health, welfare and safety of the City; and <br />WHEREAS, the proliferation of pawn shops, tattoo parlors, body piercing salons, <br />and used automotive sales may affect the development and re- development efforts of the <br />City and the Community Redevelopment Agency (CRA); and <br />WHEREAS, the City of Casselberry has found that it is necessary to impose a <br />temporary moratorium to allow sufficient time for the City to study, review, hold additional <br />public hearings, prepare and adopt new regulations for pawn shops, tattoo parlors, body <br />piercing salons, and used automotive sales; and <br />WHEREAS, a temporary moratorium on permitting the business use of pawn <br />shops, tattoo parlors, body piercing salons, and used automotive sales will result in <br />identification of the most appropriate regulation of these uses for the City, the protection <br />and enhancement of the adjacent uses, and the adoption of a regulatory ordinance, as <br />appropriate; and <br />
