benevolent, relief, rescue or similar organization, association, corporation or society; or soliciting <br />subscriptions to any magazine or publication of any association, corporation or society. "Peddler and <br />solicitor" shall include persons engaged in soliciting information door -to -door, including but not limited to <br />door hangers and flyers, for the purpose of polls, surveys, and similar activities for a commercial purpose. <br />Except as otherwise specified, "peddler and solicitor" shall not include persons engaged in the exercise of <br />their constitutional rights of freedom of speech and political activity. <br />Political means any effort by a candidate for election pursuant to Florida or federal law, or any effort <br />to advance or effectuate change in governmental laws or practices. <br />Premises means any residential or commercial lot, including but not limited to the yard, the <br />residence, building and any accessory buildings, garages, or other structures on the lot. <br />SECTION Ik Section 26 -67, "Hours of Solicitation," of Chapter 26 of the Code of Ordinances of the <br />City of Casselberry, is hereby amended to read as follows: <br />Sec. 26.67. Hours of solicitation. <br />Persons issued permits under this Article and other persons whose speech is fully protected under <br />the state and federal constitutions or who are not otherwise required to obtain a permit under 9Ub6eGtiGn 26- <br />6-1{e} Section 26 -69 shall be allowed to solicit orders from the citizens of the City between the hours of X00 <br />a.m. and a�nn p.m., 9 :00 a.m. and 7:00 p.m., Monday through Saturday, holidays eXGluded, but only upen <br />not to include the City's legal <br />holidays. a list of which may be obtained from the City Clerk. <br />SECTION IV: Section 26 -69 of Chapter 26 of the Code of Ordinances of the City of Casselberry, is <br />hereby created to read as follows: <br />Sec. 26 -69, Exemptions. <br />The following persons and activities are exempt from the requirement to obtain a solicitation permit <br />under this article and the time limitations of Section 26 -67: <br />(a) Representatives of daily or weekly newspapers making regular house -to -house deliveries. <br />(b) All solicitors specifically invited by the owner or tenant to come to the premises to engage in <br />selling, soliciting, and /or displaying merchandise of any kind and nature. <br />(c) Charitable and non - profit organizations, which hold sales tax exemption certificates under F.S. <br />212.0602.212.08(6), and 212.08(7)(k) -(p). as those statutes may be amended from time to time. <br />(d) Elementary, middle school and high school groups chaperoned by an adult, engaged in fund- <br />raising sanctioned by a school board. The term "group" refers to a nonprofit sports team or school club and <br />does not include for - profit groups or clubs soliciting on behalf of for - profit organizations. <br />(e) Distribution of information of apolitical nature in accordance with the Constitutional First <br />Amendment right. <br />Qualification for an exemption under this section shall not be construed to excuse or authorize unlawful <br />conduct such as the conduct of vending or solicitation operations on properties without the consent of the <br />
