WHEREAS, the City has determined that limiting solicitation to the time between 9:00 a.m. and 7:00 <br />p.m. protects the privacy interests of the citizens of Casselberry, by providing a specific time during the <br />evening and early morning hours when the citizens may expect to be free from solicitation at their residence; <br />and <br />WHEREAS, the City has determined that limiting solicitation to the time between 9:00 a.m. and 7:00 <br />p.m. balances the privacy interests of the citizens of Casselberry with the interests of persons engaged in <br />solicitation, by allowing solicitation for a limited period of time in the evening when residents may be home <br />from work; and <br />WHEREAS, the City has determined that limiting solicitation time to between 9:00 a.m. and 7:00 <br />p.m. reduces the time juvenile solicitors will operate in dark and unfamiliar areas providing them greater <br />safety and protection; and <br />WHEREAS, the City desires to provide greater supervision for juveniles engaged in solicitations; <br />Eli <br />WHEREAS, the City finds that the cost to the City associated with review of applications has <br />increased; and <br />WHEREAS, it is in the best interest of the City, its citizens and solicitors and peddlers to amend and <br />clarify Chapter 26, Article III, "Peddlers and Solicitors ;" and <br />WHEREAS, amending Chapter 26, Article III, "Peddlers and Solicitors," serves a public purpose; <br />and <br />WHEREAS, words with double underlined type shall constitute additions to the original text and <br />strike through shall constitute deletions to the original text. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA: <br />SECTION I: Section 26 -66, "Definitions," of Chapter 26 of the Code of Ordinances of the City of <br />Casselberry is hereby amended to read as follows: <br />Sec. 26-66. Definitions. <br />The following words, terms and phrases, when used in this Article, shall have the meanings <br />ascribed to them in this Section, except where the context clearly indicates a different meaning: <br />Peddler and solicitor, for purposes of Division 1 only, shall include any person, whether a resident of <br />the City or not, traveling by foot, wagon, automotive vehicle or any other type of conveyance who goes upon <br />the premises of any private residence of the City, not having been invited by the occupant thereof, while <br />lawfully carrying, conveying or transporting lawful goods, wares or merchandise and offering and exposing <br />the goods for sale, making sales and delivering the articles to purchasers; or taking or attempting to take <br />orders for the sale of lawful goods, wares, services and merchandise or personal property of any nature <br />whatsoever for future delivery; or soliciting money, funds or subscriptions for himself or for any charitable, <br />
